    Neal. What I did was just a dumb mistake.The classes did open my eyes to alot of riff raff I never knew existed. I guess you think the classes were supposed to change my view about mary jane. I still feel the same way legalize it. I know plenty of very succesful conservatives that smoke every day. If I could I probably would. Its no different than the achohol or tobbaco that kills every day.

    You can check the FMCSR part 40 subpart O-Substance Abuse Professionals and the Return-to-Duty Process. That will give you an idea what you'll need to do if you want to drive again. I'm sure it will be up to your company if they want to keep you or not. I know where I work (a major oil company) we had a program that a driver could seek help and be returned to duty. You committed a small offense with major consequences. I don't think it's fair but that's the way it is. You'll be marked now forever and I'm not sure if I'd put up with that kind of crap. But if you want to drive you'll have to jump through alot of hoops. You can't take the stand that pot is not as bad as alcohol. Alcohol is legal and pot is not. And you have to put up with the hypocrites that will look down on you while they go out and drink and drive.

    Whether it's "as bad as alcohol" or not has no bearing on the situation. Me, I'm an extremist - I think ALL drugs should be legal to use. And I think that anybody caught with (pick your drug of choice) in his system should be charged with attempted manslaughter the first time he's caught. Later it can be attempted murdeer.... but I digress.

    The fact is, it's illegal - rightly or wrongly.

    Partaking of the weed is a known risk. Any driver should know that it's possible he's gonna get tapped for the test when he walks in the door at the terminal. Yes, the average time of retention for an occasional user is 2-3 days. For some people, it can be a lot longer. Why would anybody run the risk at all?

    I agree, though. Talk to the company, see if they'll accept the findings of a hair test (for date information) and work from there.

    No matter what, though, that positive result will be with you a loooooong time.


    (Oh, and lest anybody jump to conclusions based on paragraph 1: I am not nor have I ever been an abuser of anything other than alcohol. I just figure that legalizing all this crap will A) help keep the government out of my hair,and b ) improve the gene pool as the stupid people die off more quickly. I'm against seatbelt and helmet laws too - but I wear both)

    I never smoked pot but knew people who did. Most got help through rehab programs funded via the state. Upon completion, the state helped them get a job. Not sure if these programs exist, but you might want to find info about it.

    A report in DAC falls under the federal Fair Credit Reporting Act (FCRA). Information under the FCRA may remain there for as long as 7-years.

    In addition, before you may drive again you must be evaluated by a substance abuse professional and undergo any recommended treatment. Then you will take a return to duty test and legally be able to drive again, assuming there is a company out there with a corporate policy to hire someone that has tested positive because most carriers won't hire someone who has tested positive due to an excessive amount of legal exposure if you were to be in any type of accident.

    There is much more to it that that too. I suggest you read part 382 of the federal rules as a start and hope that some company other than a slimeball company has a policy of accepting a driver who has legally tested positive, assuming what you say here is the whole truth, or assuming your statement devised to make one look better in everyone's mind.

    Also, as a retired federal DOT officer I have a hard time believing it was second hand smoke, or one toke being "passed around". The level to create a positive for THC (the chemical in pot) was raised in 1997 to exclude second hand smoke. You had to smoke quite a bit of the toke to test positive!

    NielnNevada, What a joke. What a Barney. Don't admit guilt and try to take another test immediately! If you've been with the company for awhile and have a clean record they can accept another test without it affecting you. The test is not 100% accurate therefore there is the benefit of doubt. If the company will not take you back, don't stress it to much as long as your clean with everything else, MVR, Job History, etc. Another company will overlook it, especially if they are self-insured. By the was NielnNevada, what kind of pose is that with a gun. Go drink and drive then kill someone or tailgate the crap out of some 4wheeler. What a poser you are.....LOL!!!!

    Why do you insist on coming into a group and immediately begin by name-calling and resorting to infantile insults? I hope you weren't directing that "Go drink and drive then kill someone or tailgate the crap out of some 4wheeler" towards me. No positives for alcohol, drugs, tickets or accidents in my 32 years of holding a CDL. I am a professional and expect other drivers to be professional...I cut no slack to CDL holders who violate substance (drug or alcohol) abuse laws. I offered the OP a method to get his act together and prove he had turned the corner to prospective employers as opposed to your "Don't admit guilt..." approach. So please, take your name-calling somewhere else, alright? BTW, that is John goodman in my avatar from the movie The Big Lebowski...not me.
