Passenger?

    Hey so we are a small car hauling company . I'm hiring a driver who wants to take his girlfriend as a passenger with him. Does anyone of you know what are the regulations on that? Do we have to get insurance related to that or anything else needs to be done prior he starts? I tried to search the forum and found some info but nothing that is recent (regulations changes quiet often) so i thought maybe someone knows. Thanks!

    Most companies do but I would think a simple form releasing you all of ----- would be fine.

    The op is the company. He's asking what the regulation is for having passengers. I.e. certain insurance....

    Check out what's bolded. Essentially a release of liability is required. If your driver doesn't have a form filled out and gets stopped, the trooper will call the home office and ask if there's an authorization on file.

    I've had this happen twice this year, both times in Nevada. The trooper had my driver stopped on the road and called me asking if there was an authorization form for my driver's passenger. Both times, when I answered yes, that was good enough. Neither of the troopers asked for any proof of the form.


    § 392.60: Unauthorized persons not to be transported.


    (a) Unless specifically authorized in writing to do so by the motor carrier under whose authority the commercial motor vehicle is being operated, no driver shall transport any person or permit any person to be transported on any commercial motor vehicle other than a bus. When such authorization is issued, it shall state the name of the person to be transported, the points where the transportation is to begin and end, and the date upon which such authority expires. No written authorization, however, shall be necessary for the transportation of:

    (1) Employees or other persons assigned to a commercial motor vehicle by a motor carrier;

    (2) Any person transported when aid is being rendered in case of an accident or other emergency;

    (3) An attendant delegated to care for livestock.

    (b) This section shall not apply to the operation of commercial motor vehicles controlled and operated by any farmer and used in the transportation of agricultural commodities or products thereof from his/her farm or in the transportation of supplies to his/her farm

    or at least it was fine with the state for someone to ride with me during a shift lol

    Basically, the companies will have a form to sign by passenger that should anything happen. They're on their own for financial burden. The insurance won't cover passengers.

    You have to contact the insurance company and make sure they have a rider policy for passengers and you have to have a release signed and on the truck from the company so when you get pulled over by the cops, you have paper work to cover your butt.

    Here is one that I made for my company the top portion contains the company letter head and graphic.




    PASSENGER AUTHORIZATION FORM



    This letter constitutes authority for _______ to be transported as a

    passenger on Unit # XXX , ______________________ as the only driver.

    This does not authorize _________ to operate the unit at any time.




    I _______________________, by my signature, hereby release and acquit and forever discharge, Your Company Name. and their agents, representatives and all other persons of any claim, demands, and damages of any kind, known or unknown, resulting in personal injury, death or property damage arising from any accident or incident while an occupant in any vehicle owned or under contract to Your Company Name.
