Yep, your right. The problem with the FMCSA is they can have 4 pages of regulations clearly spelling something out, then on the last page you see an exception of some kind. This is the case with controlled substances. This has led to so much confusion that even the branch FMCSA offices sometimes give out conflicting guidance.Last edited: Oct 14, 2016
Reason for edit: to replace advice with guidance.alghazi Thanks this. -
Can you cite the regulation for that? Or are you saying that is what might happen at the whim of a DOT officer?
If it's the latter, I could see that potentially happening, though the likelihood is somewhere between slim and none. -
In all honestly I can't cite a specific regulation about the long form. What I am doing is using basic logic because the results of a DOT physical is ON THE LONG FORM. Edited to add that a MCSAP/CVSA/DOT officer has broad authority on this and other things. However as a driver anything to do with controlled substance use must be approved by a ME and ON THE LONG FORM.
Edited a 2nd time to add I mean chronic use not a small script for lortabs that you might use for a toothache and be off duty taking for a day or two.Last edited: Oct 14, 2016

Yep, slim to none bout covers that. As an operator of a CMV your chance of having your meds looked at is very low. The problems come from accidents. It pays to have everything in order just in case.alghazi Thanks this.
