Driving for OO or co

    Ive been driving for 20 years, mostly hauling heavy equipment. 6 months ago I started pulling tank regional. Its ok but I miss solid loads. I currently have insurance n they hold taxes. Now I have the oppertunity to drive for an OO pulling step deck with a 2014 pete 389. Pay is 45% of load, 1099. Also I'd be running all 48 for Landstar. What yas think.

    Sounds sketchy. In the expediting industry 60/40 splits are the norm for 1099 drivers. This guy appears to be giving away too much. How is he going to profit and how exactly does he define "of the load"? Is he talking about 45% of the 100% Landstar rate? 45% of the 73%+/- he gets as gross? 45% of his net after expenses which he can expense a LOT of crazy ways and pay you peanuts. I would never give up a good company job with bennies for one with no bennies that paid on a 1099. Especially on such vague terms. What does the contract look like? Is he allowing you full operational control in accepting/rejecting loads or is he looking to still dispatch you as an employee but skip out on paying payroll taxes?

    This is new to me so rollin i appreciate your input. Its 45% of gross. As of right now his wife will work with me on dispatching but in the near future he wants me to handle that also for the truck I'll be running. He has another truck he's running and this one is paid for. I do need more clarification though on the pay setup and future plans.

    There is a good chance this will be a waste of your time. What is your relationship with this guy? Reason I ask is b/c it sounds very shady. There is a big grey area with the details you gave, which doesn't mean it's a bad thing, I know a driver you has a similar deal with a friend and they have been doing it for 10 plus yrs. but they operate old school on a hand shake, the reason it works is b/c they both are honest and both have a lot of experience in the industry. The driver runs the truck, books his own loads and maintains the unit. The owner pays for expenses, 1099, and pays for a one week vacation every year to Hawaii. It seems to work well for them and they both make very good money. It would very easy for either of them to take advantage of their arrangement. If you don't know this guy very well, then best to have everything in writing from him and the wife.

    Thank you guys for your input. It really got me thinking and doing some research. After reading some posts and online contracts I feel like I've come up with a list of important details. Please if anyone else has any input I'd like to hear it to compare with what I've come up with.

    You need to see a contract and go from there otherwise this is all just speculation. The devil is in the details.

    Why not buy your own equipment and run for who ever you want?

    Yeah if you are 1099 might as well be in full control of your equipment. I just don't trust 1099 "employee" jobs when good paying W2 jobs with full benefits are so plentiful in trucking. Why for the life of me I will never understand why are truck drivers always so intrigued by a big screw job?

    I like driving at least for now. Been driving local since 2000 and just went on road 6 mos ago. I would absolutely love to my own truck so I could run it my way but right now thats just not a option. Honestly what intrigues me about this ordeal is that big shiny pete 389. I gotta say though, thank you for the wisdom and advice. Its def got me looking at all this differently and more thoroughly. I'll keep yas updated on it. See I haven't quit my current yet so not completely dedicated to this yet.
