Yeah, reread my post. I said you can smoke you just can't do it within 25' feet of the carg. Meaning that as long as you are 25' or more from your cargo you can smoke. Meaning you can't be sitting in the cab puffing a cig.

You are correct, that is the rule. There should have been both A and D for the answer. This is why one should study from the CDL manual. There's a few truck questions on the test.
-
W
We'll the question on the test was while transporting any of those, key word transporting.
Anyone wants to read it 397.13 -
§ 397.13 Smoking.
No person may smoke or carry a lighted cigarette, cigar, or pipe on or within 25 feet of -
(a) A motor vehicle which contains Class 1 materials, Class 5 materials, or flammable materials classified as Division 2.1, Class 3, Divisions 4.1 and 4.2; or
(b) An empty tank motor vehicle which has been used to transport Class 3, flammable materials, or Division 2.1 flammable gases, which when so used, was required to be marked or placarded in accordance with the rules in § 177.823 of this title.
even if its way in the back of the trailer, if it contains flammable you can't smoke within 25 feet. Think of the truck + trailer as a single unit, you can't smoke within 25 of that entire unit.Blackshack46, snowman_w900 and slim shady Thank this. -
Wrong. Do it all the time just keep your windows up.
-
Wrong don't get caught.
Windows up works though. -
True but you go by what's in the CDL manual not the green book. All the answers to the test is in the manual.I took my hazmat test and passed with 100% because I studied and studied till I knew the chapter in my sleep.
-
No, you go by the green booksnowman_w900 Thanks this.
-
No you do not.Not when you are at the DMV taking the test.On the road yes but at the DMV No.The wording is different.
-
no, you cant. they consider the entire unit as being connected to the cargo. you are now driving a HAZMAT vehical at that point. your driving a placarded unit, therefore, no smoking in the cab. I know a couple guys hauling propane that got tickets in ohio and Indiana.slim shady Thanks this.
