And aiming for the leg or firing a warning shot will be construed by the lawyers to show that you were overreacting, because if you truly were afraid for your life, (which is the only legal excuse for drawing a gun in most places), you would not be shooting somewhere other than where you are trained to shoot, which is Center Mass.
By the same token, if you shoot in the head, you will probably be charged with murder, (unless you have gotten 2 rounds in center mass first, and the threat has not stopped yet.)
The only time you may display a gun, is if you reasonably believe your life is in danger, and all you are allowed to do is follow your training, for the purpose of stopping the threat. Not killing, not wounding, but stopping the threat.
And once the threat is stopped, you stop shooting and call the cops.
Oh, and if you draw the gun, and the person stops being a threat, you can no longer fire, so it is important in training to make drawing and firing 2 separate events. Too many people train to draw and fire in one motion, and then accidentally shoot when they intended to just go to low ready.
Quite a few cops have gotten bit by that one...

I really am amazed every time this thread comes up. Listening to the cb i thought everyone was a tuff guy. Sounds like many need to remember they are men. If you are scared, do pushups, situps, ect. Get in better shape and defend yourself. Maybe ask who ever has your b#lls if you can have them back. We really have become a country of cowards i guess.

I'm a huge gun guy and second this. If you draw your weapon, you better be prepared for what comes with it. If you kill someone trying to kill you, even if justified, you will immediately be arrested and charged - (charged most of the time, arrested 100% of the time.)
If I draw my Glocks or my rifles I intend to kill you. It's as simple as that. God willing, I never have to. I only aim for your center mass, period. Any gun guy (X military or law enforcement) knows why.
As for the question, I know police officers personally that always carry, legal or not. They'd rather be sent to prison than be dead. I, in a lot of ways, agree with this.
I would never live in a state that doesn't recognize my rights. Not privilege, rights. Why some in this country allow the government to regulate their rights is beyond me. Even if you are ignorant to guns, you shouldn't be ignorant to historical precedence pertaining to governments control over people's protection. Stalin took the guns, Hitler took the guns, Mau took the guns etc. why in the world would you allow a protected politician to tell you how far you can go to also be protected. It's insane. You are taking political positions too far. There's a current politician that claimed "AR-15's" aren't useful in self protection. Here's the problem. She said it while being surrounded by secret security servicemen holding? Yea, AR-15's. Do the math.
Non "violent criminal"truck drivers should be given free reign to carry whatever weapon they choose. They are hauling thousands of dollars of merchandise and are known soft targets (unarmed, sleeping, in a confined space).
Although, I'm against most background checks, gun laws regulated by states, and any attempt to diminish the second amendment. Yes, I've never met a gun law that I agree with. Violent Felons, that's it. I don't like stamp laws that only allow the rich to possess machine guns, tanks etc. why should the wealthy have means to these weapons but not common men? Gun laws ONLY restrict law abiding citizens and common men. And yea, if you've got the wealth, you can even own tanks.
Bottom line, carry, only draw if you intend to kill. Otherwise, you could easily end up dead. Understand the seriousness before you carry.
For those that say "you don't need a gun, carry weapon "X"", they've never been faced with death at the hands of a criminal willing to do whatever is necessary to take what you have; I can promise you that.Last edited: Nov 5, 2016

At the end of the day, it all boils down to the prosecutor and your lawyer. I would not aim for the head but if you missed center mass in the fray, I don't necessarily think that would be a automatic trip to jail. Just aim for center mass anyway, mainly because it's a easier target to hit.
In my small town, I know people that have gotten away with all kinds of stuff while confronting a robber that would technically be grounds for charges. Mainly holding them at gunpoint until the cops arrive and firing at the robber as he runs away. None of them resulted in charges but we are a small town and the prosecutor has a lot of lead way, especially if he doesn't get push back from the public. Your mileage may vary and nothing is saying they won't try to make an example out of you if you end up in the same situation.Ke6gwf and Claysapparel Thank this. -
If a civilian kills another man, whether justified or not, they will be arrested. Not that I agree, but the law is almost always interpreted that way. Charges are different. You will also be sued by the criminals family, both civilly and criminally.
Shooting center mass shows a skilled shooter. Aiming for the head makes no sense. It LOOKS like murder, and is ultimately determined as such in lots and lots of cases.
Center mass is a bigger target and stops the assault. The reason for defense with a weapon is to STOP the assault, not kill the individual. But a person with a gun must understand center mass can kill, mostly will kill, and also stops the aggression.
The end game is to stop the criminal from killing oneself. Not necessarily to kill them. It just so happens they go hand in hand.

You know how the cops justify using a gun against a knife, if the distance is close?
The same is true with a little training, and the bad guy with the gun.
At close range, I am just as dangerous with a good stick as I am with a gun, so if you are truly paranoid or scared and feel the need to protect yourself, get some hard self defense training, something that you will always have with you, never run out of, and not be automatically arrested just for showing you have it.
It will even make you safer if you do have the gun, because it prepares YOU as a weapon, and whatever else you have is just an accessory.
I hear a lot of reliance on a gun as your saviour, which means that is where your focus will be. So if it jams or gets lost, or you reach for it and realize you forgot it in the shower, you are now lost and naked and helpless, which gives a big advantage to the bad guy.
On the other hand, you train to become the weapon, and be able to use whatever you have available to extend your reach and multiply your power, and whatever situation you are in, you are already better off than the bad guy, because you are stable and grounded.
Oh? You also have a gun? Great! You can conserve some energy and reach out further.
No gun? *shrugs (this means it won't wake up all the other drivers!

Anybody remember Indiana Jones and the Temple of Doom, where he is fighting with the bad guys with his whip, and then a guy comes running at him with a sword, and he pulls his pistol and shoots him?
That wasn't in the script, but he was feeling sick that day of filming, and just didn't have the energy to use the whip, so he shrugged and pulled the gun, and they decided to leave it in.
He used the gun because he was lazy basically.
Now, if I am facing a bad guy with a gun, would I prefer to have one? Of course!
But guess what, most bad guys that attack truckers don't have guns, so you don't need one either!

At the same time, this line of thinking has gotten lots, and lots of men killed. You never assume an attacker doesn't have a weapon. I don't care if you are a truck driver or a man on the street. If you attack me, and I fear for my life, you get 2 rounds to the chest, period. Lazy has nothing to do with it, and this isn't hollywood. You either ENSURE you go home to your family, or you gamble.
Of course, If a company tells me no guns, it's no guns. I am actually a weight lifter and consider myself strong and capable. But nothing beats a criminal with determination like a glock. Again, I lost my best friend in 2004 to a criminal with a gun. I understand it better than some. But I agree with some of your points for sure. -
Yes, in small towns, or relatively gun friendly places, a clearly justified shooting may not end you up getting arrested or charged, but usually that is only true if you are local and know by law enforcement.
As a driver, you almost by definition will be a stranger, and so will probably be arrested to make sure you don't just drive off if nothing else.
I mean, even if you shoot a guy half in your cab, why should they believe your story? Maybe you were having an argument with him because you broke his mirror, and now you are claiming he was trying to rob you, and he is no longer able to tell his side of the story.
