No, not at all. He provides contract power. He can haul for ABC Oil in the morning and XZY Freight in the afternoon. Or he can have multiple trucks (he does) doing both simultaneously. He has full control over the who, what, where and when. He is not "under the control" of any company, he has chosen to enter into an agreement to provide contracted power. It is not the same as being a lease operator.

I did the same thing with my trucks. Most of my loads were for one or two companies, but if it was slow, or I didn't like the rate, I simply picked up the phone and found other loads with other companies. I was even a third-party carrier to Landstar; hauling Landstar loads (alongside Landstar trucks), but not running under their authority.

I can do whatever I want, whenever I want. I've had 2 trucks running for competing carriers before.

 

A lease operator is when the truck is leased to a carrier and is operated under their "authority", their insurance, etc. The individual that owns the truck cannot enter into any agreement to haul freight without the explicit approval of the carrier. The truck owner is not the carrier. @dustinbrock is a carrier. He enters into contracts with other companies to provide a power service. If he were in the U.S. he would have his own MC and DOT numbers.

 

A friend is leased to Westcan, they pay all insurances and plated. He runs under their safety fitness and under carrier on his logbook it says Westcan.

I have my own nsc number and run under my own safety fitness which is essentially my Own authority" and it's my carrier profile . I pay everything and under carrier on my logbook, Brock Transportation.

 

So tomorrow morning you could go pull a trailer for Walmart no questions asked
