Strictly personal opinion here, but from what you have posted, I believe it is already time to get the customer involved. Of course they may deny requesting you, but then again, they may not.
It's possible that the customer is wondering why you haven't billed them already, if they were not specifically billed by the dealer.
And I don't believe threatening to take someone to court, should ever be used as a bluff. Don't say it, if you won't do it. And if you are willing to do it, then put the "notification," (not threat,) in writing to them.

What blows is the matter of how much money, and time do you put into it, with the possibility of it all just going in the pit, and never getting anything back out.
