The Constitution hasn't failed. Those elected to office who have chosen NOT to uphold the Constitution but rather further their own personal interests (money & power) have failed the Constitution. Those who have been appointed to positions under the Constitution and rather than upholding the Constitution have rendered decisions based NOT on the Constitution but rather their own personal "feelings" (making their decision and then looking to precedent and foreign law to justify it) have failed the Constitution. A Supreme Court Justice, for example, should not place "precedent" above the Constitution. The danger of using "precedent" is much like the old telephone game you may have played as a kid, where one person comes up with a sentence and whispers it into the ear of the next person, who passes along what was said to the next person. It doesn't take long for that message to change, often times unrecognizable by the time it makes it around the circle. Precedent is no different. Perhaps the first decision was made based upon the Constitution. The second case based upon the decision in the first. The third case based upon the second. Fourth upon the third, and on down the line. Before long, the decisions being made have absolutely NOTHING to do with the Constitution and often times actually run counter to what the Constitution might clearly state.

The Constitution is not to blame, but rather the men and women charged with upholding it. This failure of the "political class" is what has led us to where we are, where a man who has never dabbled in politics and has no fingerprints on ANY of the power grabs made by government, has just taken the oath of office to become our President. Whether he will choose to abide by the Constitution and reign in a bloated government, or follow in the footsteps of his predecessors in office is yet to be seen. One thing we know for certain is what would have happened if his opponent had won, which is why it is a good thing the Constitution has protections to ensure that a few large cities cannot easily drown out the voice of the people in the rest of the Country.

Agree to disagree. It failed on day one when they couldn't even abide by the pre-amble. "...promote the general Welfare, and secure the Blessings of Liberty to ourselves..."

On day one there was no liberty for so many. As for promoting general welfare, again, a certain segment of the population was totally failed on that front.

Has it gotten worse? Sure. But it was a lie from the start. In my eyes, that's a failure.

That is your own failure, judging history based upon your present circumstances. It was a different time back then, before mechanization on farms and in factories. Funny little tidbit about your righteous indignation over the alleged injustices found in the Constitution: If it had been solely up to the Northern states, blacks wouldn't have been counted AT ALL in the population. It was the slave states that insisted they be counted, leading to the 3/5 compromise. I'd bet you are also ignorant to the fact that the Constitution of the Confederate States of America placed more restrictions on the slave trade than did the US Constitution, which didn't address the issue until after Lincoln's war had come to an end.

You and I can agree one something here. It WAS a different time back then. Of course that could lead to another discussion about the usefulness of a document written a couple hundred years ago but I see no point in it.

im sure we would agree on most of what would come up in a discussion of the above topic. but this time i was talking FMCSA merely due to the thread topic.

on the 34 i was referring to the rule stipulation of two 1-5 am time periods in the restart, which i believe was rescinded but nonetheless was the rule for a few years. the fact that these stipulations are added and retracted so arbitrarily calls into question the science in making these rules.

you could start to think these agencys are regulationg merely to justify their existence.

The Constitution didn't fail and I don't think the original politicians failed. In and amongst the PEOPLE you have a few idiots that ruin things for everyone. Laws are meant to curb the idiots but then you end up with such a mess of laws that it just screws up everyone.

That was kinda my thoughts. Not that I find anything egregiously wrong with the Constitution but I find the people who treat it like the most perfect document that was ever written or even will be written a bit much. Especially when some of their favorite parts are amendments. I guess they don't know what that word means

ELD has posed no problems for me. But I know you guys arent the "outlaws" running 3 logs to get to your destination. Ive seen em and I know em.....And I know they are the reason ELDs are here to stay. Dont be suprised if you see em built into trucks computer and scanned on wireless networks at every state line and ramp and weigh station. You grumps remind me of history of any technology saying it'll ruin the world!!! lmao. The television was called the "Devils box" by some. Pick any technology and it was all voodoo meant to persecute you guys. Prepare for hourly pay and normal hours..(Unless an O/O) And yes they can live without you "cowboy".
