Employee status for driver; owner operator

    Never mind. I'd really rather not go into it as divulging details could alert the company involved. Bottom line: can the company also be held liable for wages ic the leaser doesn't pay up. I think the answer is "no".

    No. The driver is an employee of the truck owner.

    I own the truck that I am driving. Running under the authority of someone else. Subcontracted to another carrier.

    I had to go through the process of obtaining my independent contractor license with the state of Montana. Company A pays company B who pays me but I call company A to get my loads assigned. Company B does all the paperwork. Everything else is on me.

    The main reason for having to get the independent contractor license was for workman's comp waivers and to solidly establish that I was a contractor and not an employee.
