Okay so i need some advice here, i picked up a car from an Adesa auction going to a dealer, no broker just directly dealing with the dealer through CentralDispatch. I have pictures of pick up & delivery, now there is a small chip on the windshield of less than 1cm, yes about 8mm almost not visible and the shipper is claiming that it should have been noted on the Gate Pass at time of pick up so he could make Adesa responsible for it, but Adesa is telling me that even if it is noted on the Gate Pass, the pictures i sent them are enough proof and that they won't open a case because the chipped windshield is way too small and they won't consider paying for it. Shipper is trying to make me responsible for it and asking a few hundred dollars for this.
How should i proceed? shipper is clearly trying to take advantage of the driver, evidence is on the drivers side so how can i make him pay?

ADESA sells the vehicle. BUYER owns the vehicle. HE has to make claim against Seller or... BUYER just has to replace the windshield. It's a hundred bucks for glass. If the BUYER is present and physically examined the vehicle and BID for it he dam well KNOWS that glass is chipped. Adesa has nothing except gate check. Once a vehicle is OUTSIDE OF THAT GATE. It's YOURS. NOT Adesa. IF the buyer bought it online and did not see chip? tsk tsk tsk. Always something with them used cars.
I myself have ADESA experience for 5 years or so. Ive done everything from parking cars to crew bossing and eventually crew truck sales foremen herding newbie cdl temps and taking tractor trailers and RV's into the barn for sale.
If a vehicle gets outside of the ADESA gate without a documented damage? Sorry bud. The buyer pays. IF YOU damaged it as a driver. The BUYER will get his pound of flesh out of you.
Im not here to give you trouble my style of talking is rather rough, but there is a whole lot of love and sympathy for your troubles. But as you apparently did not damage the vehicle yourself you can rest easy and let the buyer bark with ADESA and seller. Or cough up a Benjamin and put new glass on them cars.Leo01 Thanks this. -
Adesa knows about the chip and that's how the car was bought, they're just telling me that they can't be responsible for it because it's too small and below $500 also. So the buyer is making excuses to not pay me, how can i dispute or leave a complaint that will get him in trouble? i have evidence and he's completely in the wrong here...

The dealer is telling me that we as a driver are obligated to note things on the gate pass, is this true? we are talking about a 8mm chip on the windshield, not even ####ing visible unless you look for it really close...

Ok Sir. Let's see.
Document everything. And if they do not take it from your paycheck or sue you etc you will be ok as long you don't actually lose money for that damage.
If they DO go after you and take the money from the pay or sue you etc. Bring everything to show evidence to defend yourself.Leo01 Thanks this. -

OSD = Overage, shorts and damaged
