    ....but im not going to loose any sleep over it any time soon
    If it's war they want, it's war they will get,
    Ill keep notes reffering to this incident if i have to get down & dirty with them sec.392.3 will stand in my favor while their own track record will speak for itself and i will get a better job at the end of the day
    Hopefully it won't come to that

    392.3 doesn't mean ####, when you have had adequate time to get rest. You are supposed to be a responsible adult, which means taking care of your off time so you can functionally operate at work. Most companies have clauses that you cannot turn down loads without repercussions.

    Further, the idea of the OP that somehow office personnel would be a part of the blame should he choose to operate is beyond funny.

    Yeah well , it worked
    And yeah 392.3 is pretty simple:
    "Ill or fatigued drivers can afford to refuse to drive any equipment without any repercussions from any transportation company "
    This means even if you had a 10 hr break and you didn't get the rest you needed you stil have the right to refuse to drive any equipment for ANYONE if you are tired or sick and by law the company cannot fire the driver for this incident or related to this incident
    ....They are already in hot water with the DOT so it didn't take much to shake them up alittle

    I like them , they treat me good so i hated to play hard ball with them ,i DO have one dispatcher that seems to want to stab me in the back every chance he gets, i guess
    he thinks i want his job so i think he had something to with this.
    ....Poop usually floats to surface so im gonna give this dispatcher plenty of rope to hang himself without my help
    My goal is to fight clean as much as possible sometimes this takes having some help from above but i try to do my part

    Funny how this all works. I used to work for a smaller company pulling a skateboard that ran paper logs no Qualcomm yadda yadda.... I would sometimes get asked to run oddball loads that "nobody else was available for" when it worked out monetary wise I was willing to get creative, sadly those days were over. Found out that no longer was I getting a higher rate. Asked them about it and response was sometimes we have to take one for the customer. That is when I calmly said no, wrong that's on you guys. I will no longer be creative, you have 130 other drivers that could have been available. I'm not going to put myself through this and get same rate as some rookie. I figured 8.5 years with company clean MVR, no preventables, no issues, and good performance reviews account for a little extra. They disagreed. I was told times are tough not much better available out there. Well we parted ways shortly after. Luckily I fell back azzwards into another job that amazingly appreciates a good clean record, and doesn't ask me to do anything creative. Just be safe and professional.
    Funny how some companies find a driver that is willing to work, will push him and then abuse the driver. But when asked about it tell the driver tough, sorry you're only being paid the same as Joe blow who has rolled his truck, destroyed the Conestoga and dumped coils in Wabash river. And they wonder why driver turnover is high can't find good quality ones, and the ones they do have mysteriously disappear

    I don't understand your concern. You told them as it was. Do they not know that a man wants to sleep at 3 am? Maybe they will let you sleep at 3am next time.

    I hear ya coover:
    It's one thing to be a sport and hold value at the company ( not being a. Company butt surfer)
    But it's another thing when the company refuses to be apart of the risk involved and stands in a position ready to pin all the blame on the driver.
    And then to put a cherry on it, they won't even come to the carpet and show the driver some appreciation by throwing in a few extra bucks in on the deal
    Because all that matters to them is they got their frt moved and someone else took all the risk and did all the work

    When these kinds of men go home to their families, i wonder what kind of examples they set for them

    Sooo did my first day at this tub haul. Boss rode a few rounds then tells me I need to go faster. Got a couple of speeders in the string. That didn't go well for him. Maybe this job isn't for me. I drive my road. Finished the day and the boss ask if I will be back Monday. Like they say. You drive your truck & I'll drive mine.

    That was my plan tall joe. ..
    I planted a seed in their brains that will hopefully remind them not to pick me for special projects

    It probably would've been different if they didn't mess with my money and then expect me to bend over & flip my skirt up for them
