The 34 is an option but if he is using the 60 he should probably be on his 34 restart because he can only drive 1-hour tomorrow.

If he must work and cannot take advantage of the 34 right now he could complete the run assuming the carrier operates every day of the week but is the carrier does not operate every day of the week he can only drive 1-hour tomorrow because he must use the 60-hour rule..

The hours he shows working he never needs a restart because he never exceeds 60 hours in 7 days . With the hours shown if he worked 8 hours Monday the 20th he would have worked 57.25 hours in 7 days .
But if he was done by 4 p.m. Saturday he would have a full 34 hour restart by 2 a.m. Monday and no need to take part of Monday off . If he was done by 8 p.m. Saturday he could start at 6 a.m. Monday . -
that's where I'm falling down. Wouldn't last monday fall off? As I understand it, onthe 70 hour rule, you count the current day, then 7 days previous for your 8. I'd think that for the 60 hour rule it would work the same way. He'd count Monday as day 1, then SIX days back - which would take him through Tuesday last.

OOPS: You're right. Been a while since I had to do that stuff manually..... I'm so used to using the software that I seem to have a brain #### Re. how to do it manually. I sincerely apologize.

It can be a bit confusing and why a recap form is helpful . Our logbooks have 2 recap forms inside the cover - one for 70/8 and one for 60/7 . I keep a close eye on the recap toward the end of the week to be sure I can complete a run before accepting it and figure my restart to see when I'll be available to start back . At times I've wondered if I could do a 2 day run at the end of the week . If I have 28 or more hours left I just have to ask myself if I've easily done that run in 2 days before .

exactly - and that's why I kept a detailed record of every run I've made. My memory may be going, at my age - but my records on the laptop are backed up and always there.
I also have copies of my logs, so I can break down a trip by segment, if need be. The current dispatch may not have the same endpoints, but if a portion of the run is across highways I've traveled, I can pull the log and see how log it took me to get from (say) Spokane, WA to Lewiston, ID.
the records show road condtions (rough/smooth/hilly, etc) and whether there was any construction on that route -
DAY 1 10-12 0.0
DAY 2 10-13 9.75
DAY 3 10-14 10.25
DAY 4 10-15 10.25
DAY 5 10-16 9.75
DAY 6 10-17 9.5

TOTAL 49.5
DAY 7 hrs available 10.5
The next day you will only have 1 hour available to work
However if you have 34 hours off regardless the Officer will see that as a restart and won't fine you (well shouldn't fine you) "if" your company says your in violation that's just crazy).
I had drivers at first saying I am not going to mess with the restart and I tried to convince them however they still had it set in their mind they wasn't working more hours in a week for anyone. Hello it helps you stay out of violation.

Don't hold me 100% to the 60/70 hour rule but it only makes sense to do about the same as the 70/8 hour rule. So chime in if I am wrong "someone with knowledge of the rule" only.

I suspect his company is taking their stance based on the intent of the law. Rather than the language. The intent, is to prevent 60/7 drivers from taking advantage of the reset during the 7 day period, then extending their 7 days, into 10-12.
The language of the 60/7 basically allows the week to "start anew" after 34 hours.
While you can't use the 34 hr reset during that seven day period. It can be used to mark the end of a seven day period. Thereby giving you a fresh 60 to start with on Monday...as in the original posters case.
He would have a NEW 60 to start with every week, if he maintained that schedule without fail.
And like you, I doubt seriously that any Officer would nail him for it on Monday or Tuesday. Especially since he was allowed a reset (technically), by virtue of his time off.
Did that make any sense to anyone?
