ELD compliance due date

    I agree about he 4th Amendment, it don't apply. I left my Constitution in the truck but, what does apply is Post Roads. If you use the Road, you are under Constitutional law and that is why they (the FMCSA) can mandate this new law. Same reason the Gov. can mandate seat belts, drivers licenses and anything else they see fit.

    Well the sad thing is large corporations are the only ones who stand to benefit from this rule making. This thread isn't a debate about the legitimacy of them or not so I'll try not to head in that direction. But when millionaires stand to make more millions off gov regulations that they themselves were very much responsible for getting passed, I see a problem.

    Talk to some.of the Mercer guys. Unless they have changed, their ELD has a plug in for the data port and then uses a tablet or phone for the necessary log ins, etc.

    I agree the mandate began as a way for the large fleets to force the small guy to use the same technology for a competitive advantage and driver retention stand point. I doubt they will actually increase safety, I will agree with that as well

    The real money grab lies with the device makers themselves, you should see the numbers I have seen while setting up my marketing agreement. I am going to make some money from these but my supplier is going to make a killing.

    Well duh that's what I'm talking about. Some ceo's of these companies are in bed with the large fleets and the ata. They all win at our expense.

    I think truck prices will stay about the same for all throw away trucks. Your decked out W9's, 379's, possibly 660's will go up maybe a couple of grand at most. Let's not forget a rare Volvo with a Cat Engine either. It's a foolish business move to get rid of a truck you've been running for a 1999 Century Class just to stay on paper logs.

    Brian is right. The extension to 2019 is for devices that also have go be hooked up to the engine or ECM for compliance. If you could just load up an app on your phone and buy two more years then everybody would do that. Clearly that's not the case.

    Here is the biggest reason the FMCSA wants ELD's. From their guidance:
    • Provide data in a format that’s standardized and can be transmitted to law enforcement in a number of prescribed ways, such as wireless web services, USB, or Bluetooth 2.0
    In other words, The FMCSA (law enforcement) will now be able to contact any carrier and have the log data transmitted to them in the same format. And those with EOBR's will have the same requirement 2 years hence. No need to send someone out in the field and examine a few sample paper logs manually.
    1. The FMCSA with the appropriate algorithmic programming will be able to analyse an entire fleet's log patterns and determine any irregularities, in minutes. They will be able to compare those trucks on ELD's with those on paper, our JJ Keller paper log scanning equipment will put it in the same format. So, when drivers with pre 2000 equipment consistently log more miles at higher average speeds than drivers with ELD's in the same fleet it will be obvious. Same with law enforcement in the field. So a pre 2000 truck is just going to put a big target on your back.
    2. There are several large differences between the EOBR's currently in use that do not make the ELD standard. Example: Carrier set variables. How far and at what speed can a truck travel before it automatically goes to driving? There will be no variables when the ELD mandate is fully implemented, all fleets will be the same.

    Is the mandate going to be delayed? Unlikely. Would you like to be the congressman who tries to explain to his car driving( and truck hating) constituents why he is favor of letting the trucking industry continue to maintain HOS records with a pen, ruler and a piece of carbon paper? That is ludicrious, and political suicide.

    No, OOIDA should give up this fight and shift to where it belongs, rewriting the flawed HOS regulations, which is the real culprit.

    Agree completely, especially the part about OOIDA shifting their focus to a complete, workable rewrite of the hos regs. That is where the most good will come from. I would like to see the breakdown of OOIDA membership with regards to how many are true independents and how many are leased to carriers that already require eld compliance? I imagine the actual percentage of their members that would benefit from a reversal of this mandate is small compared to their actual membership, but it looks good that they are fighting this. The average driver probably thinks if they win in the Supreme Court the elds will disappear from company trucks, which will never happen.
