3 weeks unpaid +bomb

So, I've been working for this owner for a better part of 2 months. We were leased onto a company that did reefer based out of Chicago.. Well going on 4 weeks ago now, I stopped getting paid. Old man I work for says he hasn't been paid, I'll get mine when he gets his.. well, today I send a txt message to the dispatcher that usually handles my loads.. She quit, and hasn't been paid either, says the guy that owns the business most likely is closing up shop. I stopped driving last week because I dont work for free, obviously none of us would. The old man owes me around $3600, and cant afford to pay me.. I can't drive the truck now because 1, It has a headlight out, 2 Doesn't have insurance, 3 the plates are no good now so says the old man, oh, and no insurance. So technically Im not holding the truck as collateral for unpaid wages, but... I'm kinda leaning on that idea.. what's the legality on all this.. obviously I need to contact an attorney for unpaid wages.. but what do I do about the truck? Should I be a dick, and have it towed? Charge for storage since it's sitting on my property? Throw some ideas my way, it'd be much appreciated.

Yeah, I kinda got the gist of that reading other posts. Technically though, the truck is not legal to move, and it's just sitting on my property. Im thinking why not charge the guy storage right? But yeah to answer the other question, I am 1099.. I have phone records, text records. I made sure the company we were driving for sent me a copy of the statements. They just never got around to paying the guy.
