New Driver. Background issues. PLEASE HELP!!!

    First off, I would like to thank all who chose to respond to my post wether negative or positive. I'm a 25yo male who will be graduating CDL school on 6/15/17. My journey has been very long. At the age of 18(2010) I found myself n a bit of trouble n pled guilty to a felony conviction for robbery. Couple hiccups after that. One drug charge and one assault. But both of those are in the process of being expunged. Although at this very moment they still show up on my background. I have hope a to stay local. But I've come to realization that with no experience and a mild background that's highly unlikely.

    I'm pretty frequent on this forum. I do much more reading than posting.

    I've been reading up on many companies and have applied to quite a few. I follow up all apps with a phone call in 2 days. I'm far from a ignorant or stupid person. I'm very respectful. Just made mistakes.

    I've grown a liking for Freymiller and Boyd Brothers. I've applied for both and have short conversations with recruiters. Freymiller has started running my reports and they called me yesterday with questions of my background and the 3 charges on there. Although I want to continue to apply to multiple companies. I don't want the old charges which are set to be expunged to keep showing up. I have two points on my license. I've kept solid employment since the 2010 incident. No employment gaps. I work in a group home at the moment. Just looking for maybe some advice as to what path I should be going in. Thanks everyone for the help.

    Seems like you're doing everything right so far.
    As for the local jobs, check with some temp services that place cdl-A drivers.
    You'll get an OTR job for sure. Maybe Freymiller will call with some good news.

    Sad to say. Freymiller. Just emailed me with a denial letter. I will continue to put my all into my job search.

    I went from school to a local flatbed job. Loose the self defeating attitude and introduce yourself at the local barns with your resume and certifications in hand, you may surprise yourself.

    No way at all self defeating attitude. I come into every situation with confidence and joy. I know who I am and what I offer. Any company would be happy to have a man like myself. But do to my hardships. I'm just n for a tough ride. I know it will be hard. But giving up is not a option. Will definitly keep every one up to date on all my progress

    Theft conviction as a Felony is a big time problem.

    If it is fraud or Robbery.... It falls under section B.

    Section 1. List of Disqualifying Criminal Offenses for Hazardous Materials Endorsement
    Part A: Interim Disqualifying Offenses
    A driver will be disqualified from holding a hazmat endorsement on a CDL if he or she was convicted or found not
    guilty by reason of insanity within the previous seven years or was released from prison in the last five years for any of
    the following crimes:
    a) Assault with intent to murder
    b) Kidnapping or hostage taking
    c) Rape or aggravated sexual abuse
    d) Unlawful possession, use, sale, manufacture, purchase, distribution, receipt, transfer, shipping, transporting,
    delivery, import, export of, or dealing in a firearm or other weapon
    e) Extortion
    f) Dishonesty, fraud, or misrepresentation, including identity fraud
    g) Bribery
    h) Smuggling
    i) Immigration violations
    j) Violations of the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. 1961, et seq., or a State law
    that is comparable, other than the violations listed in paragraph (j) of Part B: Permanently Disqualifying Criminal
    Offenses
    k) Robbery
    l) Distribution of, intent to distribute, or importation of a controlled substance
    m) Arson
    n) Conspiracy or attempt to commit the any of these crimes
    Part B: Permanently Disqualifying Criminal Offenses:
    A driver will be permanently disqualified from holding a hazmat endorsement on a CDL if he or she was convicted or
    found not guilty by reason of insanity for any of the following crimes:
    a) Espionage
    b) Sedition
    c) Treason
    d) A crime listed in 18 U.S.C. Chapter 113B—Terrorism, or a State law that is comparable
    e) A crime involving a transportation security incident
    f) Improper transportation of a hazardous material under 49 U.S.C. 5124 or a State law that is comparable
    g) Unlawful possession, use, sale, distribution, manufacture, purchase, receipt, transfer, shipping, transporting,
    import, export, storage of, or dealing in an explosive or explosive device
    h) Murder
    i) Conspiracy or attempt to commit any of these crimes
    j) Violations of the Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. 1961, et seq., or a State law
    that is comparable, where one of the predicate acts found by a jury or admitted by the defendant, consists of
    one of the offenses listed in paragraphs (d) or (h) of this section
    Part C: Under Want or Warrant:
    A driver will be disqualified from holding a hazmat endorsement on a CDL if he or she is wanted or under indictment in
    any civilian or military jurisdiction for a felony listed under Part A or Part B until the want or warrant is released.

    Throwing in a similar list against those trying to get a TWIC.

    Let's get right to it.

    Disqualifying Offenses

    PART B
    INTERIM DISQUALIFYING CRIMINAL OFFENSES

    Conviction for one of the following felonies is disqualifying if the applicant was convicted, pled guilty (including ‘no contest’), or found not guilty by reason of insanity within seven years of the date of the application; OR if the applicant was released from prison after conviction within five years of the date of the application.

    • Unlawful possession, use, sale, manufacture, purchase, distribution, receipt, transfer, shipping, transporting, delivery, import, export of, or dealing in a firearm or other weapon. A firearm or other weapon includes, but is not limited to, firearms as defined in 18 U.S.C. 921(a)(3) or 26 U.S.C. 5 845(a), or items contained on the U.S. Munitions Import List at 27 CFR 447.21.
    • Extortion.
    • Dishonesty, fraud, or misrepresentation, including identity fraud and money laundering, where the money laundering is related to a crime listed in Parts A or B (except welfare fraud and passing bad checks).
    • Bribery.
    • Smuggling.
    • Immigration violations.
    • Distribution, possession w/ intent to distribute, or importation of a controlled substance.
    • Arson.
    • Kidnapping or hostage taking.
    • Rape or aggravated sexual abuse.
    • Assault with intent to kill.
    • Robbery.
    • Fraudulent entry into a seaport as described in 18 U.S.C. 1036, or a comparable State law.
    • Violations of the Racketeer Influenced and Corrupt Organizations Act under 18 U.S.C. 1961, et seq., or a comparable state law, other than any permanently disqualifying offenses.
    • Voluntary manslaughter.
    • Conspiracy or attempt to commit crimes in this section.
    PART C
    UNDER WANT, WARRANT OR INDICTMENT

    A person will be disqualified if he or she is wanted or under indictment in any civilian or military jurisdiction for a felony listed under Part A or Part B until the want or warrant is released or the indictment is dismissed.

    That is all I have for now.

    If you cannot get that theft off your record and cleaned off many trucking companies will not hire you. There is additional DAC restrictions imposed on those who steal or those who stole, fraud etc. Some of it life time. Others 5 years, some 3 years and a few a number of months. You literally will find yourself barely able to hire on as a dump truck driver or something small for a while until your time clears up before trying to get back OTR.

    Also.

    One big thing.

    If you have a Felony conviction that stands, Canada is barred to you. Many good loads go there and come out empty. And sometimes with the exchange rate it's like a 30% pay increase just to go there when your expenses when expressed in American dollars fall.
