Unsecured Load...Accident?

Don't figure or assume anything. As posted contact a lawyer. The cost of a descent lawyer to save you some big time headaches later is priceless.

 

Get a lawyer.
You weren't driving.
You were loading truck, how can it be an unsecure load when you were in the process of loading?
It didn't fall off your truck.

Get an attorney, you don't want either the accident report or the ticket on your mvr or recordef any where else.
Until it is processed on the day of court, the judge can dismiss it and/or change the charges.

I agree, get a lawyer, you don't need to do anything except meet with one with the intentions to retain them if you need them, that way if you have any issues, you can say right at the start - talk to my lawyer - and hand them a card. We were discussing this tonight, I have a strict policy that my drivers keep their mouths shut and call the company lawyer 24/7 on any issue. Some of us were watching law and order and they drag some idiot into interrogation and they start babbling on, which gets them into trouble.

So get a lawyer retained, it may cost a hundred or so but it will be worth it if there are issues in the future.

 

Anything is changeable, if it's proven wrong in a court of law. Sure to original will be in a file box somewhere (or database), but the court order to vacate it will be with it so it will never been seen again.

 

Why?

The report is not a report of a moving vehicle, if the company is paying for it, don't worry about it, it doesn't matter. The cop was wrong, the ticket could be tossed but the damages are already documented and the report is part of that documentation.
