    I have a question about the split sleeper berth rule.
    eg.
    I pre-trip at 8:30 am. At 6:30 pm I have 7 hours driving, 1 hour on duty, and 2 hours off duty.
    10 hours of 16 gone. I have a six-hour window and six hours driving. I take 3 hours in the sleeper.

    Do I now have a three-hour window remaining, or a six-hour window.

    Does the 3 hour SB "pause" my 16 hours?

    The rule is a bit ambiguous.

    • In the time before and after each period:

      • The driving time does not exceed 13 hours,

      • That there is no driving after the 14th hour on duty; and

      • The elapsed time does not include any driving after the 16th hour.
    • So it says that in the time BEFORE and AFTER the elapsed time does not include any driving after the 16th hour. So is that the 16 hours before and after, or the 16 hours from shift start?

    You now have 3 more hours left

    You start at 0830
    You are done 16 hours later, or 2430. If your 2 hours off duty consisted of blocks of sleeper or off duty that each were not less than 30 minutes you can take an 8 hour break starting at 1830 ending at 2630 and your new shift now begins at the end of that 8 hour or at 2630 (230am) the following day.

    Alternatively you could take sleeper from hour 10 to hour 13 and drive from hour 13 to hour 16, at which point you still must take at least an 8 hour sleeper. Make sense?

    Why doesn't the 3 hours in the berth stop the clock?

    Start day used up 10 hours with 7 driving and 1 on duty, sleeper hour10 to hour13, the 16 hour window still closes at hour16. Does it not? At which point he would still require an 8 hour sleeper. Think I have it right.

    Better get the expert.

    At no point would he require an 8 hour period in the berth. It can be divided into two periods, each of which must be at least two hours and which must total a minimum of 10 hours when combined. 2 and 8, 3 and 7, 4.5 and 5.5 etc. And they stop, or pause, the clock thereby extending or recalculating when the 16 hours is up.

    Good thing I'm on scheduled run. 38 years trucking and I do not really know the rules since I know I'm legal usually, other than the odd occasion. Really should have a cheat sheet on my dash. My logbook has been inspected exactly once in 21 years on my run, i had gotten delayed enroute.
    Did get a logbook ticket in Nipigon On in '88. Was running 3 Montreals a week and was "confused" Got it dismissed in court.:)
