Unopened beer can in truck

    My last employer found I had unopened beer can in truck at company terminal no police, no ticket involved. Is this incident a DUI, DWI. Prior to this I had clean MVR, clean PSP, no ticket, no accident, no DUI. How can I find driving job now ? Please give advises. I feel hopeless.

    no it's not a DUI......at worst it's a violation of
    FMCSA
    §392.5 Alcohol prohibition
    (3) Be on duty or operate a commercial motor vehicle while the driver possesses wine of not less than one-half of one per centum of alcohol by volume, beer as defined in 26 U.S.C. 5052(a), of the Internal Revenue Code of 1954, or distilled spirits as defined in section 5002(a)(8), of such Code


    (c) Any driver who is found to be in violation of the provisons of paragraph (a) or (b) of this section shall be placed out-of-service immediately for a period of 24 hours.

    Shoot. Just go to any truckstop after a weekend. Beer cans in all the trash catchers. Life on the road. It is what it is. Those boys down there in Georgia sure like their beer!

    You will be placed OOS if so, there is a giant sticker that goes onto the windshild where your face would be and there it stays until the OOS term has expired for you. Do NOT whatever you do try to leave that spot during OOS. They would bend you over hard and ream you good.

    If OOS does happen, it's going onto your record most certainly I think either PSP or CSV points on your company which will make for interesting reading when the entry is made for possession of alcohol.
