Yes you can (see Post #29), assuming your carrier does not have a policy against it.
Or, if you're up here, then so long as it isn't within the driver's reach you're good to go.
-
Your example is only for a driver using a truck while off duty. Like I used to do sometimes when I drove bobtail to get food. It is STILL ILLEGAL to be on duty with alcohol in your possession. This is a VERY VERY LIMITED exception and is only for using a CMV for a personnel conveyance. On Duty in interstate commerce it is prohibited. If your except quote is taking this into account I agree with you. If you are trying to convey a position otherwise I can't.

Nope, sorry. It means when operating a CMV NO alcohol can be in the CMV. There is NO only within reach clause in the US rules. Be careful of this on duty off duty thing. The FMCSA was specific enough to say an exception was to have a billed load. If they were saying it was OK to have in the sleeper it would have been also listed.Last edited: Jul 11, 2017
tscottme Thanks this. -
No you can't unless its on a BOL as freight. You cannot have an alcoholic beverage in your commercial motor vehicle otherwise. Period.

You should try reading the regulations and associated guidances (as posted in this thread... links and everything
).

Just for the record 393.5 uses the term CMV. A CMV is defined as any vehicle used in commercial commerce over 10,001 rated weight. Keep this in mind!

Generally I find driving the same roads with Canadians a problem but I like this rule.
-
Careful. I think that within reach comment was directed to being in Canada. Also in a limited exception while driving a CMV while off duty it is legal.

I have read the regs and clearly understand them. That would be the ones in the United States of America; #### Canada. Any questions?
