Bad News Day

    Decided to get into trucking after retiring from military, went to school got the CDL A. Thought I was set, then get phone call from a recruiter I thought I would be seeing concerning getting started, only to find out there is a hiring freeze in place for student drivers, bad news. So I called a couple of fall backs to see about orientation and during the process of "elimination" found out that neither will hire or even talk to you anymore once they find out you have had multiple DUIs, 7 years ago, more bad news. I can't really figure out where this since of forgive and forget has gotten to, I guess sobering up and finding the Lord and serving a year and a half in Iraq, engaged twice, and helping to provide the very freedom's we here so much of wasn't good enough. Can anyone help with a decent company name who might share my philosophy of "I apoligize, already".

    Try to find a company friendly to veterans, other than that, there is a hiring freeze in many companies on inexperienced drivers, they are no longer as desirable in this economy.

    7 years would be plenty for a single DUI, the multiple is considered more of a pattern. Multiple violations of any kind send up a warning flag.

    I'm sorry but I find it very offensive that you're trying to use your time in Iraq and the military to get ahead and eliminate stupid mistakes.. I thank you for your service but there's plenty of vets here that take care of business and don't expect a hand out. That's my opinion and I served 20 years to say that.

    I flew A-4's & A-7's off 2 different carriers during the 60's & 70's and saw more SA-2 SAM's (they look like telephone poles with a tail coming at you) coming at me than I could ever count. There were usually 6 or 7 during each attack & we flew 2 or 3 sorties a day with sometimes 3 attacks on each sortie.

    I never had 2 DUI's so I suppose it is merely a matter of what questions the motor carriers are asking. If they were more than 7-years ago they shouldn't be on your driving record because an MVR and a DAC (credit report) fall under the Fair Credit Reporting Act (FCRA). Data under the FCRA may only remain for 7-years. I must therefore believe that these carriers are asking questions seeking a longer time period which is permissible, or you are interpreting something incorrectly. It is also permissive for a motor carrier to ask you if you have ever had a DUI at which time it is permissive to not accept you based on the individual criteria of each individual motor carrier.

    You also have the legal right to request in writing why you were turned down by these motor carriers provided you make the written request within 30-days from the time you were refused employment. Have you done that?

    I'd also suggest that rather than complaining, you should do some research on what rights you do have.

    In the meantime I'll offer a sincere thank you for your military service.

    Try some of the smaller mom and pop companies, sometimes they are a little more forgiving. But be careful, may not receive a paycheck everyweek for services rendered. I myself came into the trucking world with suspensions, and other multiple driving offenses. I couldn't get a job with any of the super carriers. After continuously pursuing and investigating I managed. That was 12 years ago, and now my record is clean and I can go anywhere I want. Hang in there.

    i am not looking for a hand out!!!!!!!!! Only some guidance from someone with some experience in the trucking industry!!!

    I don't want it to seem as though I'm complaining, I'm merely finding it hard to believe that even after you "have paid the price" you still owe a debt never to be forgotten. Thank you for hour help.

    7 years ago probably isn't long enough ago for most companies. My hubby had two from 16 & 20 years ago, and there are companies out there that won't hire him. Length of time and number are two factors there. Just keep trying, you will find a company.

    Was this rule instituted just recently? The reason I ask is because I have had a DUI (December 2, 1997). I was convicted in April of 1998. During the sentencing phase, the Judge said, "Mr. #####, your driving record is horrible!"

    I was dumbfounded—my MVR had been clean for the previous 9 years—no tickets, no accidents, no nothing. My curiousity got the better of me, so I obtained a copy of the court [transcript?].

    I found that the judge had pulled my MVR all the way back to 1980, when I first started driving. Now granted, my MVR *was* horrible... for about three years after I got my license—suffice it to say, I had a lead foot. This was the horrible driving that he was taking into account—15 to 18 years PREVIOUS!

    Unfortunately, with computers and instant access to data we have today, this DUI will probably haunt you for the rest of your life. I went through my own hell almost 9 years after the fact when I was refused admittance into Canada (after crossing the border daily for almost a year). I was living in Sarnia, Ontario with my wife and kids who were in the process of immigrating here to the states. Needless to say, I couldn't go over there, and they couldn't come here until the immigration was done. My kids were crushed and couldn't understand why dad couldn't come home.

    As they say, "what's done is done," you can't change the past, you can only affect the future. Good luck with your future.

    DAC falls under the fair credit reporting act (FCRA) the federal law required that data older then 7-years be removed from a document that falls under the FCRA. Same thing for an MVR. Judges and cops within any state can do that within an individual state
