Short haul exemptions

    Im a stone transfer hauler for local quarries where i live. Been doing it 3 yrs as a company driver. As a short haul driver i know i dont have to take a 30 min break, but am i entitled to one? 3 yrs and im getting tired halfway thru the day. Never once have i taken a break. Ive benn searching the regs for 2 days and cant find anything. Help me out please

    It is not a requirement that you take a 30 min break. You are exempt. You don't have a lunch break?

    You cannot take a break while getting loaded??

    And if the company gives you flak make sure you meet all the provisions of the exemption.
    1. 100 air mile radius from terminal
    2. Must start and stop day at the same location.
    3. Cannot be on-duty (including driving) for more than 12 hours.

    If you meet all 3 and want to take a break, simply pull in somewhere and stop. Do whatever you want and go back to work whenever you want. Thats all betwen you and your employer though.

    But I would go a little further if it was me, just my thoughts, ####em take a break if you need to. The problem with this #### industry, people want to push and 80k hauling person to far. I haul local for a few months out the year, get tried I shut down for a few.

    Look up the 12 hour rule and you'll find your 30 minute break. I think it's always been there. Long before the rules were changed for the first time in 04.

    Ive been going thru my green book and the fmcsa website. All i can find is the part where im exempt from taking a break. I live in ny and like otr or any other job by law you are allowed/forced to take a 30 minute. But as we all know trucking is a different animal.
