Using temp drivers

    We were short handed on drivers this week. I was telling a friend of mine about this (he owns trucks also) and he said he had a couple of drivers he could spare if I needed some help. I told him I appreciated the offer but I was unsure how legal it would be.

    Is there a way you can legally "borrow" drivers from another company for a couple of days? I'd think there would be but said temp driver won't be in your drug testing program or in your driver files.

    I've done this before.

    Back when I was pulling a dump trailer one winter they pawned me off to some other company with about 6 trucks for pushing snow. Seems to be fairly common practice for construction companies.

    You just gotta add them to your insurance policy, do drug test and you are good to go

    You can't pay the drivers directly. you have to go through your buddy's company so they don't become your employees.

    After you set up a driver qualification file, just like any other driver, you can use them. Most of that info your buddy already has. Then lease the drivers from him.

    actually, this would be the way to do it.....just act like your buddy is a temp agency. He needs to understand though any accidents or whatever are on him.

    Insurance is covered by the vehicle not the employer, workman comp however would be on the employer

    Yes, if I used his drivers, I would pay him, not the drivers.

    I'm just wondering if I would have to have a file on temp driver and have him drug tested or would the guy I "borrowed" them from take care of that? To be honest, it would be more trouble than it's worth if I had to drug test and create a file for a driver you are only using for a day or two.

    I've used temps. Yes to drug test and driver file.

    Look at it this way, if you need help now, you might need it in the future and then you're set.

    As long as you can prove they are in a drug testing consortium it does not have to be yours
