So now I need to find where I can get a contract online for us to have our driver fill out saying that he will be with our company for a couple of years and that he cannot leave us to go to somebody else that we are working for. Does anybody know where to find one of those that I can download for free. I honestly do not know a lot about this Trucking stuff and I just kind of threw myself into this with not knowing anything and I am learning more and more everyday so that's the only reason why I'm on here asking questions is so I can learn more and I can get better at this job.
I was told by my driver today that the company we are sub hauling for tried to poach him.

If you handed me said contract, you would be pulling pieces of it out of your backside for the next week....Plus anti poaching contracts and noncompetes are not enforceable in some states.

Your better off getting it in writing with the company you haul for, mutually saying neither will take employees from each other.

At least the driver told you about it and didn't just jump ship. If their offering more then you then this is your chance to offer more if this driver is worth it. Otherwise you know what to expect. Sometimes just giving an employee a little more goes along way. It might not have to be as much as the other just something. They might not want to leave at all and just need to feel like they have some value to you. If this driver has proven to be safe and reliable for your needs then give a little to keep him. You may go through a half dozen drivers trying to find a good replacement and bad drivers can loose small companies reliable work. Just remember money talks and BULLS**T walks

Send the carrier a bill for 20% of what that driver grosses as a "finder's fee". Seriously, if you want to avoid having your employees poached by the carriers you lease onto, that is a matter that needs to be dealt with in your contract with those carriers...NOT with your employees.

He already said he will sign because we found him with no experience and gave him the opportunity of a job and I wanted to know what exactly are in those kind of contracts. I'm just trying to get information before I go forward and I want to know what my options are. Like I said he had no experience at all when we first found him and we have given him an opportunity because nobody would hire him because he had no experience at all. We will guarantee his pay because I am on the phone everyday all day on the computer and constantly looking up trucking companies to make sure that we are going to stay working.

I already took it up with the company and they denied it but our driver is okay with signing it I just need to find one that's legal and one that's not asking too much of him four of us and just something that's fair because we do plan on keeping him busy no matter what I have to do because I am constantly working my ### off to find us a better job and keep us employed
