Or maybe merging on the expressway...
In either case I would simply wait until tomorrow, call the safety department of Werner (or whoever it was he "hit") and demand a copy of the video.
If it's clear that he did, in fact, hit the Werner truck, simply exchange insurance info and move on.
In either case of video, or no video fight the ticket.

As for the ones saying about altered video... Well, the reason Werner driver cannot produce it is it's uploaded to Werner's safety department. There is no way to get it from the unit itself (if they are using the same one I've have to deal with, which is very common on fleets)

Um, sure, OK. Maybe you can get your wife to jump in here and give some real legal advice to the OP.[/QUOTE]

Are you questioning the validity of the state statutes I posted? They are both explicitly clear and both apply to this situation. If you don't believe my wife is an attorney, you can actually watch her be sworn in by United States Supreme Court Chief Justice Roberts so she can present cases before the U.S. Supreme Court. That happened today, about 8:30 a.m. at the court building where she works and I believe it's online, it was on the local news a little while ago.

Tell me how those statutes don't apply. Just because he is a cop not following the rules doesn't mean he couldn't possibly be charged with filing a false report. In fact, subsection C of 16-17-722 specifies police officers who knowingly file a false misdemeanor report. The other establishes that he has to witness it to issue the citation. Please tell me where I erred.

4 lanes. One lane split to another highway. I'm in the 2nd lane and get over to what would eventually be the middle lane. I rode in that lane for 5 miles and the. He comes up and waves me down. Me thinking I have a flat or some other issue pull over and he tells me I hit him.

Right here. You just stated your not sure if you hit him or not. You also where cited the ticket. You can lawyer up but you need a better story. If you didn't hit him you should be standing on the mountain tops proclaiming innocence. Not this wishy washy I don't know what happened nonsense. Not trying to be smart. I'm pretty sure you hit him.

Why is that headlight bucket so clean, not a single remnant/piece/part hanging from a fastener or wire. If that part of your trailer did that kind of damage to his front end, why is your marker still intact when it protrudes further than the rest of the side of the trailer, that lens would have been shattered had it raked sheet metal and a headlight, and the grommet displaced or missing.

Ok, obviously you want a throw down. First, I believe your wife is an attorney and I was serious about maybe her being able to help the OP. For the second part, you are obviously butt hurt that I called you out about it not being true that an officer has to observe in all cases an offense in person in order to charge a misdemeanor. After that you tried to cover your bases with what I would deem a bunch of legal gibberish about the duties and legal authority of the officer. You assume a lot, as an example that the case is in SC. Where does OP state that fact? Now you are saying the officer is not following the rules and can be charged with filing a false report? Do you even understand what you are saying? I really do not feel I need to school you in some of the finer parts of the law. Some of the mess you spouted was equivalent to truck stop lunch counter crap.
There are quite a few retired LEO's on this forum. Maybe they will be along here soon and explain it to you better than I can.

That's what doesn't make sense to me. A tree limb knocked off one of those grommets last month. They are cheap plastic.

It first I just chalked that up to the 5 miles of chasing the op down. All the wires are likely hanging down under the hood.
But in looking closer at the pic I did notice the fender is damaged, and 7 or the 10 lug nut covers are gone That wound be kind hard for a sideswipe I think. Dunno. Like I said earlier I'd be calling Werner safety in the morning.
