I started this program on 10/6/2014. I was a five year agreement with a rewrite after the first year this was to see if it was a fit for both parties. The next rewrite would be in two more years leaving the drive with two years to go. Well it was time for my last two years and I get a call from my account manager saying that my name came up on a list for a buy back and I could get a new truck. When I ask if the money that I had put into the first truck would carry over to the next one. I was told that it would not and I would have to start over. Well of course I said no to that. And because I said no. Schneider demanded the truck back. Yes, they broke the agreement and still wanted the last three payments of the agreement before the next rewrite. I was not behind on my payments. I lost my truck because I didn't want to upgrade and continue to lease.
I didn't make any money with Schneider. I went a month without a pay check. Loads were taken from me and given to company drivers. So I could go on like this. So, I ask my Account manager if I could take the truck to another company and my manager got with review board and presented my case and I was given premission to do so.. Bottom line don't do it. I'm out of business and I should be. There's more to this horror story but I don't want to post it all.

I don't get why they wanted to take the truck back if you stayed with Schneider but would allow you to take it to another carrier.

I would still be in business if I would have agreed to the upgrade. Schneider wanted me to continue to lease and not own. And that was not why I got into this. Who wants to lease for ever.

SFI doesn't even operate like this. The options are a 1 or 3 year trac lease with option to buy the truck at lease end for a predetermined figure. Signing an all new lease on the truck is also an option if SFI decides to offer the truck again.
If you went a full year and made no money, why would you sign up for two more?
Three years and no money and still wanted to stay on so bad you allowed SFI to illegally repo the truck after they told you it was fine to replace SNIs stickers with someone else's?
I've never heard of a "review board", you notify SFI of your intentions and which company you're signing onto, front three weeks of payments and that's it.
What advice did your attorney give you when you were first notified by SFI that they were breaching contract?SuperRookie Thanks this. -
My guess is he had a pre CMS truck. SNI doesn't want any of them in the fleet, thus SFI "buys back" the truck.
His lease expired, he didn't have a plan, and they shut him down. Sadwar, 48Packard, freighywiper, and DFO (of ever honored memory) all had their plans and contingency plans in place MONTHS in advance. It sounds like this guybflee by the seat of his pants.
The review board would be SFI asking themselves - if this guy takes the truck will we get our money? -
and I'm not hatin' on the OP, but it seems like sometimes folks don't understand that a lease is no more than paying someone to use their stuff and at the end of the term, the lessor can do as they please with the equipment.......the lessee has no rights whatsoever to the equipmentbzinger and gentleroger Thank this. -
So much for trying to help others. If you don't know what your talking about then you should not reply. I know what type of lease I had. And my account manager did go to the review board. And I never said I worked a year without pay. I will not be posting again. If by posting my experience and it helps one person, I will have done my job.
