how they gonna keep it on there if the company is out of business? If you dispute it and it can not be verified shouldnt it fall off thats what happens with a credit report.

In most cases, just like with a credit report issue, the reporting company will not change their comments on the report and they don't automatically fall off just becuase a driver rebuts and the company's info cannot be verified (only the reporting company can remove the comments). However, the rebuttal is right there and future companies can see both sides of the story. If the driver's rebuttal is well-written in a professional, non-accusatory manner and written in a way that doesn't look like an attack on the company, most viewers would more willing accept the driver's account as having validity. Now in the case of driver vs. closed company, the hiring company can go to the driver for more details and the driver would have an even better chance of swaying them in his/her favor. Since the company is closed, it would be hard to get more details. Proverbs says that one sounds right until another comes along and questions him. This is why, in the American justice system, the defendant goes on the bench last.

All you have to do is dispute the entry and by law DAC has to contact the company and give them 30 days to verify the information and after the 30 day period they have to, by law, remove the entry.

I have only one entry on my DAC and it shows that I was involved in an incedent in Effingham, IL where I was not at fault. I had never been east of Missouri while working for that company and called them immediatly and they removed it right then.

As far as a company that advetises that can "fix" your DAC/USIS record, that's a bunch of crap, they cannot do anything more that you can yourself. Now with that being said, everything has to be handled through the mail and if your away from home for long periods of time it might be worth it to have that company handle it for you just to expedite the process. But again, you can handle that by signing a limited power of attorney with someone at home and still handle it on your own.

Nope... DAC reports are more like "criminal records" than credit reports.

as with criminal records - they stay permanent.

i.e. - nothing "falls off" after an alloted time.

I might add that "abandonment" could include leaving a company truck anywhere except exactly where they wanted it.

i.e. - I know a guy who got abandonment on his DAC at Dick Simon back in 1998... because he turned in a truck at the Atlanta terminal - where he hired on at...

(but they wanted all turn ins to be done in SLC) (main terminal)

His dispatcher told him to park the truck -and clean it out - and to bring the keys to the shop etc etc - never mentioned the whole SLC thing.

    anyway

Abandonment could be as severe as leaving a truck in the middle of the desert - or in your own driveway...

    or even on company property...

all depends on how you handled the situation - and how vengeful your former employer was.

I dunno about credit reports, but if you challenge a DAC entry it falls on the company to supply additional information to prove their claim. If they cannot, then the entry is removed.

They drop off anyway after 7 years.

you rebut the abandoned truck... they check, when they can't get a response. it must be removed... double check because there is NO one looking out for you and your interests except YOU.

Because *in general* most of these companies are rip offs maybe? Because you can only learn about them after working for them firsthand maybe? Because of a strong desire to earn the most you possibly can maybe? :smt017 Because of a desire to find a company that pays better and has a little respect for it's employee's maybe? There could be several deciding factors aside from the one you may be hinting at. Nothing personal intended here.

you will not find what you are looking for jumping from one "fast food" trucking company to another -

you have to step up to a higher level of trucking...

Or you could pay attention to the stuff that is written on this board about some of these companies. A bit of advice--the biggies are not paying as you put it "the most you possibly can earn". This is why these boards are here--so people can learn what to expect at some of these places. I mean if there are some 100+ pages of "bad" about some of these companies, why would you even consider them either for training or for a carreer? Unless maybe you think that your presence on their payroll will change them and make them out to be something great or even tolerable. Hate to rain on your parade, they are not gonna change either for you or anyone else, they have been doing business like this for years and are not interested in change at all. You know that most of them have a prospective drivers list that is so long it would make your head spin. You quit and there is always 1 (or more) suckers that will take your place. You should look at this site as kinda like consumer reports--when you are looking for a TV, why would you buy the one that Consumer Reports has rated as the lowest one? You will probally want the one that is rated at the highest that you can afford. The same with these trucking companies that have all the complaints. Why would you choose one that has all the complaints from drivers, former drivers and others in the industry? Im not picking you out in general, but a lot of these new drivers are not interested in what the others who have been there and done that have to say, then they get into one of these companies and are right back over here in several months telling everybody about how bad it was, and how much they were screwed. But see, we already know all this, but they couldnt be bothered. We see this on this board ALL the time!

Some of these companies have a lot of problems and are evidenced by everyone you talk to, some are only problems to those that pretty much bring it on themselves by thinking that they know it all when they get there and they are the change that trucking is looking for(BTW, those drivers usuually dont make it)and some treat their drivers like they are supposed to. A driver should look at a company like this--Is the company in business because they have drivers? Or, Does the company have drivers because they are in business? The companies that understand the first question are the one's whose drivers for the most part like the place and praise it, the companies who dont get it follow the second question because they dont get it, and they see drivers as expendable commodities. Sadly there are more of those than the first.
