    Yup. They use words like "unladen" and "short distance." Those are going to get them in trouble because even their inspectors are not agreeing with each other from what I hear.

    He was not "unladen" by many LEO standards. A trailer, empty or not, makes the tractor "laden". One may need the tractor to get to their sister's place, hence PC, but they don't need the trailer to get there. And therein lies the gray area of unladen vs laden, and some LEO's take the view that if one is pulling a trailer, even empty, then PC does not apply because the tractor is laden.

    Yup. They will be needing to define this point and the distance point for sure or they are going to get into fight after fight. For this week, an empty trailer was considered "unladen" in Oregon and Washington. Next week? Who knows...

    Utah POE scalemaster witch Is one that I've called stated that if you come through with a trlr and get pulled in and your claiming PC your getting popped.

    "FMCSA said it will be issuing “formal guidance” on the existing hours-of-service exemption for the agricultural industry and on the “personal conveyance” provision for all truckers (which, simply put, refers to when movement of a truck by a driver is not subject to hours-of-service regs), as well as on how enforcement procedures should be carried out once the rule legally kicks in on Dec. 18.

    The agency also said it will provide guidance on the existing 150 air miles hours-of-service exemption “to provide clarity to enforcement and industry. The guidance is designed to allow industry to maximize the use of this statutory exemption.”

    FMCSA noted that formal publication of the guidance in the Federal Register is to be “expected within the next two weeks” and will include a public comment process. The agency added that it will consider comments received from stakeholders before publishing final guidance."

    Hopefully some clarity on the PC coming soon...
