HOS for Trainers

Trainers generally do not have students with just a permit. Both are full CDL minted and stamped drivers in that tractor trailer for insurance purposes.

Trainer are usually told to stick themselves in the pax seat logging line 4.

Both are indeed subject to HOS.

Some trainers are dirty. They will go to sleep in the bunk leaving the poor trainee to wrestle with monsters that go bump in the night.

 

On-duty not-driving while the permit holder is driving or you are doing ANY instruction including backing practice in the lot, pre-trip practice, etc.

 

If you have to ask, I #### sure hope you're not actually training anyone.

 

Some of the Mega's have gotten permission to run a driver with a Permit along with the Trainer.

If in the right seat they can log 2 hours max on Off Duty, then have to be on line 4.

 

I believe that reg only applies to a team operation where both team members are CDL holders. When one member holds a permit, the passenger seat driver must log on-duty at all times that the permit holder is driving.

Summary: FMCSA announces its decision to grant C.R. England, Inc. (C.R. England) an exemption from the provisions in 49 CFR 383.25(a)(1) that require a commercial learner's permit (CLP) holder to be accompanied by a commercial driver's license (CDL) holder with the proper CDL class and endorsements, seated in the front seat of the vehicle while the CLP holder performs behind-the-wheel training on public roads or highways. Under the terms and conditions of this exemption, a CLP holder who has documentation of passing the CDL skills test may drive a commercial motor vehicle for C.R. England without being accompanied by a CDL holder in the front seat. The exemption enables CLP holders to drive as part of a team and have the same regulatory flexibility that 49 CFR 383 provides for C.R. England's team drivers with CDLs. C.R. England believes that the exemption will allow these drivers to operate in a way that benefits the driver, the carrier, and the economy as a whole without any detriment to safety.

Regulations

 

Everyone is all upset over this exemption for no reason. All it does is allow someone that has PASSED the cdl skills test to drive before they have returned to their home state and been issued a new photo card that says CDL.

They are not allowing anyhing that wasn't done back in 92 when I obtained my cdl, Pa uses 3rd party testers that stamp your permit once you pass the skills and road exam, allowing you to drive as a cdl holder until the state mailed you a new photo card. Same thing here, the CR England "students" can't drive unsupervised until they have passed a skills and road exam administered by a qualified 3rd party examiner.

This is in response to the change to the cdl skills testing program, where any state can perform a skills and road test, even on out of state permit holders. Without this exemption the driver that has passed their test still has to be treated as a permit holder until they can return to their home state and have the stamped permit recorded and a new photo license issued.

In the context which this exemption was issued "skills test" includes pre-trip, basic control (parking, dock, backing) as well as the on-road exam as defined in 49 CFR Part 383.113 so the only relief the mega carrier was granted was in getting the driver immediately home after passing the driver exam to obtain a new wallet card, nothing else no matter what the fear mongors want you to think.

That said, these mega carriers training standards are poor, they teach to pass the test not make drivers, but as of yet that is not illegal, unethical but not illegal. As a former 3rd party examiner I took my responsibility very seriously and failed many more students then I passed, but sadly some 3rd party testers don't.
