Log book required?

    Ok, been running a service truck for the same company for 17 years. Most of the time in 3/4 ton service trucks or vans. I'm currently in a f350 service truck with a 13,300 pound gvw and actual weight is 13250 pounds give or take. I cover 1/2 of Pa and all of NJ, parts of Ny state at times. I have my physical card, and run a log book as NY Dot told me I have to? Got a warning at a dot check near Corning. What is the requirement for log books on trucks this small? Everything I find is big truck info. I've never been asked for log book in pa or nj. I have received warnings for overweight by 20 pound. Out of 7 drivers of the same type truck over 6 states I'm the only driver using a log book. Question is do I really need it and since the electronic log is now in use am I required for that? My company said they Have no plans at the moment to implement those. We are changing over to larger duality vans shortly that will be gvw of 9800. With being under 10001 will I be required to enter weight stations? I will have dot numbers on it.
    Sorry for so many questions, my boss and transportation manager are not any help.

    Log books are required for trucks over 10k, unless you meet the requirements to claim the 100 air mile exception. If you're required to log today, you'll be required to have an ELD tomorrow.

    The GVW he stated (Seems like he meant GVWR) doesn’t require a CDL (Unless hazmat) which would make him a non CDL commercial driver so if he meets the requirements he may qualify for the 150 amr exemption.

    Thanks, non cld and I rarely stay overnight. Most days are within 150, but some are 240/250 range. Trying to get answers from my company is hard. They don't know for sure it seems then if I get warnings at weight stations For things they told me to do I get written up by HR. I only carry small containers of hyd oil but have a waste holding tank for 50 gallons. I stopped using that and use small containers just in case for ws inspiration.

    Since you are over 10k gross weight rating but under 26k you are non-cdl and qualify for the 150 air-mile short haul exemption. To use that you must;
    Leave from and return to the same place at the end of each shift
    Work no more then a 12 hour shift
    Have an accurate time record at your place of employment

    On the days you do not meet those conditions you must complete a log book. Effective Dec. 18, if you have to complete a log book more then 8 times in any 30 day period you are required to have an electronic logging device. Don't confuse 8 in 30 days with a month, this is a rolling period and does not reset on the 1st of each month.

    When your company switches to the under 10k vans you will then become exempt from hours of service and medical card requirements as long as you never haul haz-mat in quanities that require licensing.

    Here's the regulation from eCFR — Code of Federal Regulations

    (2) Operators of property-carrying commercial motor vehicles not requiring a commercial driver's license. Except as provided in this paragraph, a driver is exempt from the requirements of §§395.3(a)(2), 395.8, and 395.11 and ineligible to use the provisions of §395.1(e)(1), (g), and (o) if:

    (i) The driver operates a property-carrying commercial motor vehicle for which a commercial driver's license is not required under part 383 of this subchapter;
    (ii) The driver operates within a 150 air-mile radius of the location where the driver reports to and is released from work, i.e., the normal work reporting location;
    (iii) The driver returns to the normal work reporting location at the end of each duty tour;
    (iv) The driver does not drive:
    (A) After the 14th hour after coming on duty on 5 days of any period of 7 consecutive days; and
    (B) After the 16th hour after coming on duty on 2 days of any period of 7 consecutive days;​
    (v) The motor carrier that employs the driver maintains and retains for a period of 6 months accurate and true time records showing:
    (A) The time the driver reports for duty each day;
    (B) The total number of hours the driver is on duty each day;
    (C) The time the driver is released from duty each day;
    (D) The total time for the preceding 7 days in accordance with §395.8(j)(2) for drivers used for the first time or intermittently.​

    So actually there is no 12 hr provision for non CDL holders. It's a 14/16 hour provision..
    Also this is where it says you need to log (and the short haul is logging, just exempted logging)

    True but when the OP goes to the 9800 GVWR vehicle none of this applies.
