Own authority question..

    -As far as the pre employment drug test goes, I figured I'd be on the safe side if I got my test done before I did any driving under my new authority?

    The part that has me a little confused is [pre-employment] - does this mean I'm supposed to be hiring myself as a driver? Or am I just taking the drug test as the owner who drives?

    Because I'd rather file taxs as a pass through LLC and not a LLC as S-Corp type of deal. So in my case it wouldn't benefit me to hire myself.

    I am in place with OOIDA for their drug testing consortium.

    What did / or do you guys do regarding this ?

    Not to be a smart **** but you did actually read how the authority works?

    ALL drivers are supposed to have a file and in that file is supposed to be an app.

    I'm talking about how I will be viewed by the I R S.

    I know I must have a driver file and a driver app etc, I just don't wish to pay myself as an "employee" via fica wages etc...

    Rather just pay my taxes on my profit like I normally do

    Figured some one here would know. There's plenty of people who have done this successfully & not many tax "professionals" are well versed in this industry

    If you want to file taxes like you normally do when you set up your LLC and get your tax ID number from the IRS make sure that you Axtell them you want to be taxed as a sole proprietor, you can register as a LLC but still get taxed a 1090 like sole proprietor

    Yes, you are now an employee of your trucking company. You need to fill out an application and put it in a personal file. As far as the drug testing goes, you need to be involved in a drug test consortium. Odds are the place that you took your pee test has such a program for O/O with their authority. Concentra is who I used up here in the Detroit area, there was no charge to be added to the testing pool. If you have yet to go through your safety audit, you sound like a good candidate for Foley Services. I used them to get through my audit and then dropped them.

    Give her a call and tell here Mike from Waterloo MI told you to contact her. She has done my taxes for years, and was there when I went from driver, to a lease op to an o/o with my own authority. She is very familiar with the trucking industry, she worked for one of the Mega Carriers at one time in accounting. They work in all states, have attorneys on staff and have an incredibly good reputation. Also, they do not charge a retainer fee, it is pay as you go and very reasonable. Give her a call, she knows her stuff.
