I have a driver that is actually one of our sales men, meaning he never does trips... except for last week. Our salesman did one run to Massachusetts and received a violation with no citation. His violation was for not having his Record of Duty Status completed. He does not typically drive, however, I keep records for all of the trips and the driver's logs. This trip spanned over 2-3 days but I am wondering, does he need to fill out logs for off duty days prior to this trip? If so, how many?
They just had to throw this crazy loop in here since I'm the new chick. LOL.

All work for a carrier and any compensated work for anyone else must be logged. Also, a driver must have today's log plus prior seven days. Even if said days are all off-duty, that must be shown on the logs.

(k) Retention of driver's record of duty status and supporting documents. (1) A motor carrier shall retain records of duty status and supporting documents required under this part for each of its drivers for a period of not less than 6 months from the date of receipt.
(2) The driver shall retain a copy of each record of duty status for the previous 7 consecutive days which shall be in his/her possession and available for inspection while on duty.

@deathB4decaf, say your salesman works Monday to Wednesday in the office (after being off for the weekend), travels Thursday and starts driving Friday. He would log the following (assuming he travels more than 100 air miles [115 statute miles] radius from normal work location to get the truck):
- Friday (prior week): one sheet
- Saturday & Sunday: one sheet, assuming he was off-duty for all of each day
- Monday - Wednesday: one sheet each day (he could log all days one sheet if he followed the EXACT schedule each day, but not likely)
- Thursday: one sheet, see "TRAVEL" below
- Friday: as it happens

§395.1 Scope of rules in this part.
(j) Travel time—(1) When a property-carrying commercial motor vehicle driver at the direction of the motor carrier is traveling, but not driving or assuming any other responsibility to the carrier, such time must be counted as on-duty time unless the driver is afforded at least 10 consecutive hours off duty when arriving at destination, in which case he/she must be considered off duty for the entire period.

I went through and copied this information, hope you don't mind, and put it into an information sheet for our non-regular drivers. It gave me an idea to put together an "example" document.
