60 or 70 Hour Rule???

When they get audited it will be glaring if using 70 and there are 0 logs for Sunday....
Here is the text fron 395.
(1) Having been on duty 60 hours in any period of 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or
(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.

I am still trying to figure out why it makes any difference to the OP which cycle he is on.

Well, To the op. It makes a difference if 1 driver is using the 60 just because he only works 5 days when the rest of the employees are using the 70 because the company operates 7 days a week.
We work 5 days and we use the 70. 60 hours isn't enough for OUR work week.
But the op's post was over 10 years ago. I highly doubt he's still around to read the latest.x1Heavy Thanks this. -
You probably can be THANKFUL that you have now the extra 10 hours to play with. You are already into it for 60 hours in 7, 70 in 8 is not too difficult.
Give it a little time, you will understand with the 34 hour reset on your day off and change you will understand then the limitations of the current HOS.
It makes no sense to sit and shut down after 5 days or 6 days when trucking is 24/7/365.
I generally fly my computer parts by air anyway, Ive seen too many parts shipped via truck (Fed ex, UPS etc) sit and burn in the summer heat over weekends out in the SW USA. That burns up the parts before I get them. SO there is no more of that.

Forget it. He's probably doing something else long before now.
