Owner operaors right?

    any rights you;d find for an owner operator wouldn't aply anyways. he's not an owner operator he is a lease operator and the only "rights" he has is what was in his contract basicly. there is some standards that would apply. essentially I know if he was leased to work for a percentage then he has the right to be shown the full rate but there is lots of ways around that too.
    They take everything out of your check under a lease before you get it. It's essentially a company driver with a truck payment job. You guys should have checked into it and sure should have had the contract looked over by a lawer before signing. no ofense but I bet you won't do it again

    Yep, what MM said. Take the contract to an attorney and call OOIDA if you are a member. As far as rights? Like was stated above, it is in the contract. A tractor lease O/Op, lease O/Op and Indy O/Op are all different animals.

    Thank you to those that responded. In that 4 months & $60,00 Giltners cut should of been about $45,000 for lease payment, apu, fuel, etc. but now even with his final paycheck which he was suppose to get on the 9th they we're saying certain lights were not working-which they were when he left the truck, and that the starter block was cracked(i think thats what he said). Giltner also has all these codes on his paystub you can't understand. Labor and Industries of washington said that because he lives here and worked from Idaho we had to contact the Federal L&I but I can't seem to find the web site for them. Thanks to all that posted

    Does your phone book have a section of government department contacts? Ours does, including federal. I would think the state office should be able to give you the number or website for the federal office. Note: I think! This is government offices we are talking about!

    that's what you get with lease purchases. no offense but you're doing good if you don't owe them money. many people do

    Try the U.S. Dept. of Labor. That would be the applicable place for any complaint of this type.

    If you have documented proof that you should have made $60,000, you may beable to go to your local labor board and report them. Did you have a contract stating you would get 75% of the revenue?
    I'm not a lawyer but I don't think they can charge you for the fender if the insurance company already paid for it.
