Intra State Texas HOS question

    There is some kind of oilfield exemption that a lot of these companies are running under that the regular truck driver Joe will not know about.. best to ask tx dps

    off duty at well site is only used for equipment built and that can only be used for oilfield services only....a pneumatic trailer isn't one lol

    I thought it was if the equipment is specialized and all the work the truck does is on site. Like wireline, fracking, cement guys.

    so i i'm loaded and parked on a lease road @ 1200 but can't deliver until 2000, i have to be on duty that whole time? that's like saying a driver with a load of beef in his reefer pulls into a truck stop and sleeps for 10 hours has to be on duty that whole time as well...

    now i'm doubly confused.

    Are you asleep in a sleeper cab? Yes? Then you can be off duty. If you are sitting behind the wheel of the truck or otherwise not free to do what you want you are on duty. It's really not that complicated.

    You're wrong. The rules state that anytime spent resting in a parked CMV can be logged as off duty the off duty time just doesn't stop your shift clock unless your in a specially constructed unit that requires additional training to run. If he pulls into line at noon and waits until 1900 to unload he's off duty it doesn't matter whether he's sitting in the seat reading a book it's still considered off duty.

    Old post but... To answer the original question, yes peoplenet is correct. Texas intrAstate regs are different than US intERstate regs. If using split sleeper provision, it does stop the 15 hr clock. ( "The on duty and driving times immediately before and after the rest period, when added together must not be more than 15 hrs.")[so the rest period itself is not counted.] Also, this is ALL drivers using tx intrastate regs, not just crude or oilfield.

    Do i have to run eld's or even have to run a log book haulingnfracsand if I'm staying under the 150 air mile limit everyday in texas with a truck thats regisered and based out of state. Only thing is me.and truck are staying in permian basin

    Company called me that wanted me to live in the truck, work 24/7, and not take more than 4 hours/day rest, and only if I gave them notice that I was going to. They provided services of various types, they said.

    If the truck stayed on lease roads this would be legal? I thought it sounded dangerous whether legal or not.
