So I was pulled into a weigh station to have an inspection done. I drive tankers by the way and was basically given a violation of 173.24b(1) stating a release of hazmat from package. Now there was no actual release but the trailer has stains on it from who knows how long ago. Honesty the stains look over a year old and being in the chemcial industry this is a normal occurrence. The stains won’t come out Unless the trailer is repainted. Now I know DOT won’t necessarily tell the truth about things all the time but he said this violation won’t count against me, that it will be between the company and the shipper. I’m trying to find out if this is true or not. There’s no citation number and It was even suppose to be and oos violation but they let me go to the nearest tank wash to have it cleaned which after being done still looks the same as before. So can anyone shed some light?

If they wrote it up it counts against driver and company. Nothing I repeat Nothing against shipper.Puppage Thanks this. -
Yea I’m to confused about this. I mean if you have a OOS violation you are suppose to receive a citation for it as well correct? Like you can’t be given a warning for such things? Also if it is a warning these things can’t be challenged correct?

If it’s on an inspection report you can dataQ it, or your carrier can at least. For some BS deal like this as long as he took photos before and after the tank wash, he should be good to go.
That’s an Ahole cop being an Ahole. He feels good about himself, because he cut the driver some slack and didn’t park him on the spot or write a citation. -
One is cvsa's oos and inspection violation. You got points for that if a violation was written up. That's the csa and psp points.
Two is a citation. That's a ticket for the voilation. It may or may not br given. That's the diffrence in a warning vs. ticket.
They are related yes, but two distinct components. -
I got wrote up for the same thing in Colorado. There the company had to pay a fine and it showed as an oos violation on csa even though he let me go.

That’s great. I was wondering though does anyone know if csa violations have a impact on owner operator insurance rates?? Specifically if they are leased to a company?

I got a warning and inspection. For being 2500 - 5000 lbs. overweight. 5 days ago. No inspection was performed though other then basic paperwork. No warning tickets. I was told no points. I'm betting come next month when i pull up the company profile. I'll find some points though.
Gots to remember to drop the axle.
