Our commercial truck has been stolen. Person got a hold of pink slip, forged signature and other forms to gain ownership of vehicle. DMV investigator said they have a hard time proving forgery cases so they are saying I have to file a motion to the court and let the court decide who owns the truck. In the mean time I can;t drive the truck as it is insured under our company and all permits are under our co. yet the ownership is the other person's. Going through a scale may get the truck impounded.
Where do I start?

When you took out the insurance, did they take a copy of the bill of sale or lease agreement? If so, you should be able to get a copy from them or if it was purchased at a dealership they will have paperwork on it as well. I would get as much info as possible on proof of ownership before heading to court. BOL!! Hope this helps.

I would love to rake his ##### into the ground. The thing is I need to get that truck on the road as I'm the one suffering with no work. DMV says I have to take the issue to court and let the cour decide. I don't know what motion to have my attorney file and he doesn't either. I don't understand why I can't just threaten the guy to go back to DMV and sign the truck back over to me, but they said a court has to decide??

I don't know much about California but have a couple of questions.
Did you own the truck or was it financed?
Does Cali have a title certificate for vehicles? If so, was your name on the title?
If you owned the truck and had the title, I don't see how he could claim ownership without you signing the title over to him.
If the truck was financed, the bank owns it!
If you go to court, sue him for "Theft by deception", and have a handwriting expert prove his signature is a forgery!
Oh ya, if your lawyer doesn't know what motion to file, get a new lawyer.

Take your information to the police of the jurisdiction you are in, they have more balls then any DMV and as the previous post stated get rid of that attorney, gotta be an IDIOT not to know what to file on a civil matter like this.

But taking it criminal would prove your case prior to the civil issue coming up and you would not have to pay for an attorney. -
Mel, it sounds like you know where the truck is? If so I give you kudos for sure. I admire your patience.
But I would have my truck back by now one way or another. I'm a nice guy and I don't condone violence at all but there is no way in these economic times I would put up with that BS for 1 second.
Have you called the cops? Like was mentioned they may be able to do more then the DMV.
I don't recommend this at all but personally, if I couldn't get anywhere through legal means I would simply take my truck back. Stash it somewhere that nobody would find it, and then work on the paperwork issue. If I can't work the truck i sure ain't gunna let that punk work it, or strip it, or sell it or who knows what?
