    The insurance for the truck was issued directly to my husband, and he paid the bill directly from his pyastubs (I don't want to say checks because he never brought anything home). He was made to sign a power of attorney, however it was only supposed to be while he was in a business relationship w/ hirschbach. They terminated his lease in June 2004, and claimed the insurance in March 2005! That's well past the time the business relationship was terminated. His name was on the check (we have a copy of it) yet it was cashed.

    Hirschbach reported a 1099 to the IRS stating that he earned $59,000. Howvere we never got our copies of a 1099 from them to claim on our taxes in 2005 (for 2004). Being a little stupid when it comes to taxes, we figured since they gave us no paperwork we did not have to claim it, because they re-absorbed every dime.

    We just got a letter from the IRS now claiming that we owe $16,997 for 2004 based on this income we never recieved. We're going to send all of his detailed paystubs to the IRS showing that the company kept everything, and just showed on paper that he was getting paid when he really wasn't. If all else fails, we'll file bankruptcy, and it will all be dismissed. We've been putting off doing so for two years now, slowly paying on what we can....but there is no way we can pay over 16k.

    But unfortunately, at the moment of the accident, that power of attorney was in effect and for all practical purposes, the insurance claims will all surround that specific date and time, and therefore can be settled by the person appointed in the POA. It looks like Hirschbach covered their bases.

    Are they willing to send you one now? If not, You don't necessarily have to have it to fix the problem with the IRS, since they have the figure already, and you are not required to file a copy of the 1099 with the return.

    You don't need to go to all this trouble to fix this. Simply file a tax return for the year 2004. It will require you to fill out a long form return, and you will need to file a schedule C, which will list all of the expense your husband had, including all the deductions that Hirschbach, took from his check, and any cash expenses that he had while on the road that are not a part of the settlements. Once the IRS receives the return, they'll adjust what is owed to the correct amount, which sounds like it will be nothing, since you claim he made practically nothing while running the truck. Depending on the figures and your deductions, you may owe a small amount of self-employment taxes, and a penalty for filing late, but nothing more.

    The IRS lost the schedule C part of my return in 2003, and hit me with one of those letters claiming that I owed them $32,000. I simply filed an amended return to fix it. So, don't panic, but file as soon as possible to clear it up.

    If you can afford to have it done by a tax professional, go that route. If you are short on cash, you can do it yourself, if you are inclined to do so, because there is information online to give you step by step instructions, and I would be happy to give you all the assistance you need.     I live in Monmouth, IL and Hirshback is located in the old Munson Terminal there.

    When the doctor said I could get back in the truck in July, 2005 I thought I might appy with them. It would be nice to work out of the old terminal again.

    20 plus years verifiable experience, zero accidents in all of those years, driver trainer for seven years and they offered me a job at .27PM. I told them I started with Munson in 1989 at .25pM I certainly wasn't going back in pay.

    They call my house weekly now and bother my wife. Guess, I'll have to go up there (10 blocks) and speak to somebody.

    What jerks.

    Anybody know how many miles you can rack up in 20 years? That aught to be one hell of a safety award. <------Just tootin' my own horn........

    That's a slap in the face, anybody with five years verified with a good record can be offered at least .35 plus....That's a diference of $240 on a 3000 mile week....

    hirschbach motor lines has been working hard to change there outlaw image, i have been with them in a lease buying a 2004volvo and they treat us great. we make money and run as much or as little as we want, not once have they pushed us. i think they are a good company. but now i cant speek foor the company drivers, only the lease drivers.

    Funny......I spoke to one of their fleece drivers last night at the restaraunt. Said when he did orientation they brought in one of the fleece drivers. Guy told him that he grossed 60K the first 4 months of last year and cleared 40K. Guy said he was done once he found a real job.

    My roommate looked at Hirschbach last year -- really wanted to get into a Volvo. They sent us information on the lease that looked like this:

    Avg Miles 2500+ per week
    $.87 per mile -- empty or loaded
    68% of load if you choose % pay
    Stop Pay $35.oo after 1st drop off/pick up
    $.10 - $.25 mileage bonus for safety and on time delivery paid quarterly
    All permits paid
    Comdata fuel card + discounts at Love's, Petros and Pilots (at Pilots 5-7 cents)
    No money down no credit hassle Lease Purchase

    1. Truck payment $242.00 to $445.00 per week
    2. Base Plates & Heavy Highway Use Tax $51.00 per week
    3. Physical Damage $88.00 per week
    4. Bobtail $8.41 per week
    5. Deductible buy back - Included
    6. Maintenance or Mileage $.06 to $.145 per mile
    7. New Hire Escrow $25.00 per week up to $1000

    I did the math and figured on an average week -- not a great or lousy one -- he would bring home approximately $200 - $300 a week if he brought home anything at all -- and that didn't include anything for his expenses on the road or any taxes. It didn't take much of a drop in miles from that 2500 per week figure for him to owe them. This plan was way better in terms of take home than some of the others we looked at though. Some of the others, if you worked with the average miles per week and expense figures they gave you, you were in the hole already. I'm sure glad we decided against Hirschbach.     Turbo ,I Have mentioned hirshback,schanno,greenfield, burlington, and van pak. These are all owned by Grogeon, they are thieves. I lease purchased a schanno 98 pete, week 1 after all expenses except per taxes cleared 899.00,it kept going down until I gave up on week 13,that was 399.00. I gave the truck back to them. They trip lease thru their own companies listed here,double broker fee you. I came home 2 days out of 13 weeks,did not sit,running really steady. They nedd to get an accountant that knows the trucking business really well. My accountant declared my lease purchase a wash,I did not owe 1 cent. On paper it showed i made quite a bit,the net was a total loss. Van pak is better,but sooner or later you will go out of business. Remamber all the Burlington and Schanno owner operators lawsuit about 6 or 7 years ago. O.O.I.D.A. won it for the owner opts,due to truth and leasing laws. You all need to steer clear of these folks and don't waste your time there,you will go broke,they sell the same truck 10 times.

    Hirschbach just called the cops. I don't know if I can leagaly post the details but 2 drivers are very angry and are being removed as we speak.

    OK, all is finished up there now and it has become public knowledge so I can go into details.

    Hirshbach has 6 trainees staying at the Super 8. One was a husband and wife team from Ohio. The husband and wife were not selected.

    Hirschbach told the police that they had made no threats but wanted them physicly removed from the Motel. The cops did and now this husband and wife team are up at the restaraunt calling family and trying to get funds to get home.

    Not a good deal.
