Involved in a two truck MVA..have some questions.

    She did. She managed to negotiate a lower amount with the insurance company. All I wanted was the money I lost in wages. I was off for over a year. I managed to get most of it. So it all worked out.

    you might be able to sue him in a civil court. did he get a ticket?

    that's most times guilt.

    check with another attorney, there are chasers all over the place. of course, they get paid about a third of any settlement

    Yes he ended up with two tickets out of the ordeal. So yes he was given 100% blame in the accident. I will probably check with several attorneys as one that I have spoken with this past week seems to think going after the other company wouldn't be hard at all.

    and it should not be hard to go after the guy, AND his company.

    workers comp does not pay you, your full paycheck. as a result, this puts you behind in any bills you got to get paid. sueing both him and his employer will compensate that lack of funds you need NOW.

    do not feel bad, sorry or guilty for initiating a lawsuit. he was guilty. had it been (what i call) an "innocent accident", like say maybe only scraping the paint and you were ok, and required NO medical attention, then that's no reason to go and sue.

    but you got hurt, you lost a lot of your weekly pay, and you got bills to pay as well.

    So out of your settlement you ended up just drawing even? Not to be a jerk but I very easily could have been dead as a result of this accident. So yes some pain and suffering is something I would like,more so for my family. What all medical bills did you have to pay for? I have had two ER visits,several diagnostic tests,easily 15 doctors visits,PT sessions...etc.

    I suffered a TBI, which caused me to lose partial vision in my left eye. I broke my left leg. And two disks in my back herniated, one of which went into my spinal cord causing major nerve damage to my right leg.

    I had surgery to repair my back. I have had three MRI's on my head. Two MRI's on my back, and multible x-rays on my shoulder and leg. I spent a total of 13 days in the hospital. And close to 10 months in PT to regain control of both of my legs. Oh and a ton of testing on my left optic nerve to see how bad the damage was. So now not only do I have a really cool limp I also have really cool nerdy thick glasses. And I still have no feeling in one side of my right foot.

    So in your words not to be a jerk but it sounds like you got off lucky in a way.

    All together my medicl bills totaled up to over 100,000. Because of the way the laws are set up you can not profit off an accident. Which means if you get anything workers comp gets paid back first. I was lucky that I got what I did. And I am ok with that because even though it really sucked. I am still here.

    I would say you have had a very tough road just to get back as far as you have,God bless you for all the hard work you have done to get there!! I hope I didn't offend you in some way,just trying to see how things have played out for other drivers. Was your suit against the third party or the other driver? If I'm getting too personal trust me I understand.
