    Our old tool trucks had a GVWR of 8,800 which would explain us never being picked up before.

    The states decide what threashold of what is a cmv and what isn't.

    In this screwed up state, to be considered as a cmv, it is either 5500 gvw or 8800 gvw.

    But then we have this screwed up crap that anything with a gvw of 4000 lbs is considered a cmv. Then there is this other bs law that it is any vehicle used for commercial purposes.

    This comment is why I did not get too deep into giving advice. This interstate intrastate thing in regard to pickups and being different in every state is enough to make a body want to go screaming naked into the night. However it looks like from that copy of the inspection the officer listed no medical card and no USDOT numbers displayed. So it looks to me like the officer is treating this as a interstate commerce CMV. The FMCSA rules clearly state for medical card purposes a CMV is a a vehicle used in interstate commerce that has a rated weight of 10,001 or over. All I can advise is got a legal opinion if they think the officer is in error.

    Oh and that 4th violation down, it got me put OOS in Texas back in 2011. I got ate up with the stupid and forgot to check it out and for some reason the mechanics did not catch it.

    That driver better hope he doesn’t get fired. He will just about be unhireable for a while with all those violations listed, unless its a fly by night company,
