Maybe a citation, but why OOS if the driver took a 10 hour break before driving again?

Yes, and yes. PC is when you use your truck as a personal transport vehicle to drive between your parking spot and a restaurant, to go shopping, get your nails done, etc. You just have to start your next on-duty period at the same point where you last went off duty.

I'd like to know how the driver was supposed to roll at 5 a.m. and arrive at 630 p.m?

Documented orders from DM to roll no later than 5am to be there by 6PM.

Speak those exact instructions right back to DM that DM said to you prior to you rolling no later than 5 am. Then tell him again that he or she specifically said that at such a date and exact time and it's documented.

That will destroy the DM's stragety of stressing and confusing you with questions or attempts to make you feel like a child playing in the big leaques. Speak the DM's very words of instruction right back to him or her. And then tell that DM not to ask you about trip planning when you have been specifically instructed in what time you need to be moving.

Any dispatcher stupid enough to schedule your appointment for you to arrive at a end of your 14 hour clock deserves to be shot. You already know there is going to be a problem with that load. And so here you are.

The company will do whatever they have to to toss you under the bus to preserve the precious account.

Document everything into a notebook as you go through each working day. Name names. Dates and times exact and who said what to you when and where etc.

So when something like this blows up and makes a royal mess, you simply open up that Journal and tell the DM you said be rolling no later than 5 am to arrive at 6PM and no later. How dare you accuse me of not trip planning or failing to manage hours. I told you I will run out the 14 hour clock around 630 PM after your 6PM arrival. How dare you the DM accuse me of failure to trip plan, what is this BS?

The yelling should start at that point. But it wont cover up the flaming hot mess that your company committed you to with that stupid load with very bad time instructions knowing your 14 hour clock WILL be up when you get there.

You want trip planning? Great. Here is one question you should ask the MOMENT you know there is a BIG problem with your 14 hour clock.

"I need a new appointment date and time for the next day that is later than the time you come off your required 10 hour sleeper rest."

SO you are there or very close to them, legally parked and resting for the next morning you begin a new 14 hour clock unloading and we will go from there.

Document that too. Everything. SO if they suspend you, fire you, threaten you etc. Take it to your State's Labor dept or unemployment office, bring the names of the people who are your superiors and exactly what they said when and so on. When the state understands the sitaution from your POV exactly and have evidence in hand to cross examine the people such as your DM on the phone, they stand to approve your claim very easily.

The more you do this, the more 1000 or 10000 drivers do this eventually the company MUST change their practicies interally. No longer will they bark instructions at drivers knowing the clock be ###### and so on.

Maybe they deserve to lose the account entirely. That account will find another trucking company who will legally have hours to do the work on their property without fuss, muss, complaints or problems.
