You go back and confront, you have no idea what you're walking into.
I carry.. buts it's to protect ME.. not the cargo.
Call the police... start the truck, and ease out of there.
Or, just sit and wait on the police to zip in and bust em.
I know he was the owner, but at what point was HE in immediate distress until he engaged??

Agreed. IF they can prove the box cutter wasn't brandished as a weapon and the other guy had no weapon, he's got serious legal trouble. He may even have legal issues if either of those did happen. I don't really know how Michigan law handles defending someone else's life.
My personal opinion based on what little information that is available in that article is that it was a good shoot. But im not the liberal prosecutor/judge that will be looking at that case.NavigatorWife and jammer910Z Thank this. -
He shouldn't have drawn fire there. That really could have gone the other way. He was not threatened in any to shoot. It's not smart to confront thieves whether one carries or not. The situation is too unpredictable. Thieves steal for a living. There's a chance they've been in that situation before and are prepared to do whatever to get away. The best thing to do was to let him get what he wants and live to fight another day. Common sense is always the best self defense, and Ypsilanti can get a little bit rough some times with the Detroit spill over

Now yes he will have to answer questions, and the dead scumbags family will try and sue. But criminally he should be good just in the fact he was defending another from the commission of a crime. -

Bad shoot.
No one's life was in jeopardy, an innocent was wounded, no confrontation was needed.
Should've called the police and focused on providing best descriptions possible. Cargo insurance would've covered the cost of the lost freight.
As a firearms carrier myself, I can honestly say I would NOT have drawn in the situation as described. And chances are very good that this owner will be brought up on criminal charges. Not only did he confront and escalate the situation, he did NOT properly clear his line of fire beforehand, despite having the opportunity to do so.
Since he deliberately chose to confront and pulled BEFORE another weapon was evident, there is even the possibility for a Premeditated Murder charge and attempted prosecution of same. Depends upon the politics of the District Attorney who gets the case.NavigatorWife and bryan21384 Thank this. -
As a prosecutor, I'd need to know if these heists have occurred before, and maybe at the same location.
If this has happened before, at some point you say enough is enough and the suspects had to know they were pushing their luck, and those people's patience and understanding.
