He was already declared OOS for violating the HOS regs...that didn't stop him. His truck & trailer were also declared OOS for safety violations...and that didn't stop him either. This is what cracks me up about the feds. This guy has ALREADY shown he doesn't give a flying rip about being declared OOS, so what do they do? Declare him OOS again.
Definition of insanity...doing the same thing expecting different results. Does anyone (outside of the government) think he'll obey this OOS declaration?spyder7723 and buddyd157 Thank this. -
Only if they throw the cuffs on and actually put him in a jail cell. Remember, he’s facing involuntary manslaughter charges and I’m sure Kansas already has his number-a prisoner number waiting for him.

Are we to assume this driver was still on paper, or did he just ignore or disable an eLog system?
Regardless, looks like cops are going to have to carry some type of vehicle disable system when putting a driver or truck OOS, and handle getting it removed at the proper time or when the tow truck gets there. -
Article on Landline today said that he disabled the eld.

That just proves that elogs are bad, for years and maybe decades this driver drove whenever he wanted, slept whenever he wanted and just created a paper log sheet every day that looked legal.
He even drove safely for years with really really faulty equipment.
So do we really want to punish this driver for one little accident that never would have happened had he been allowed to use paper logs where he could have stopped to take a nap and not worry about the silly 14 hour rule making him late? -
Did the one cop assume he would "fix the ELD" while he was on his ordered 10 hour break on the side of the road or wherever he was?
