misdemeanor charges

    I have went to the arresting agency and got my report.

    It does not show up on the report?

    However, it does show up when an employer runs a background check or a DAC

    Hi!! Ok, here it goes...

    My sister came to my house in Texas and tried to come through my door while she was drunk AND high. I pushed her out of my house and told her to come back when she was sober. She was all torn up facially because she got into a fight with a girl for sleeping with someone else's boyfriend only an hour before. Needless to say, her "friend" that was with her called the cops and BOOM, the next morning a police officer showed up at my door. You know the drill, questions, questions, questions AND I had 2 witnesses that backed me.

    A warrant was issued for my arrest, which I graciously turned myself in, and posted bond. (Never spent one second in a jail cell, the officer made sure of that.) Went to court and my charge was Assault Causing Bodily Injury which is a class A Misdemeanor. My attorney pleaded with the court and I had to take Anger Management classes which would reduce the charge to a Class A Misdemeanor, Assault Family Violence. I was "convicted" on January 9, 2008.

    Now, I've tried to speak with trucking companies about their requirements for hiring, BEFORE I spend $3,500 to get my CDL and I'm being told that a "violent offense" must be at least 3 years old. I need this expunged from my record. Note: I now reside in the state of Georgia. HOW can I get this taken off of my record so I can team drive with my husband?

    I have been turned down jobs because of this.

    I just got back from getting the criminal background report pulled.
    They stated that this is closed and should not come up....
    They stated that it is on my credit report.
    Any advise on how to remove it from my credit report and DAC

    then you need to find out where dac is getting the information from, i believe it is the NCIC. here in GA you get your criminal background check through the GBI (georgias version of the FBI). you should take your dac report to the arresting agency and show them the info in the dac report. if the info in the dac report is in error then you need to work with the arresting agency to get it corrected.

    WOW, i can't believe your sister let you take the fall for that. i really don't know what to tell you here except maybe to go to DA that prosecuted you, maybe your sister would help you out there and see if they will show you some concessions. i guess hindsight is always 20/20, but i would never have pleaded guilty to that, i would have taken my chance in court with a jury.

    I have a misdemeanor that isn't yet a year old. It seems to be interfering with even the local jobs. NealinNevada seems to know something about expunging, what are the requirements and how do you find them?

    Sorry, I needed to read the entire six pages of posts on the subject. I looked at NealinNevada's link and googled: misdemeanorexpungementUtah, as I live in Utah. Within seconds I was on the Utah State Courts self-help website where they gave a very good summary of what's required.

    I have just started workin on getting my record cleared up, back in 2002 I had a underage drinking charge and a possession of pot charge, wich was stupid becasue it wasnt even mine. But... it looks like for maryland, as long as it was more than 3 years ago you can sumbit paper work and pay 30 dollars per charge to try and get it cleared. And it takes 3 months for it to proccess. I will let ya'll know what i find.

    In Utah if you have only one misdemeanor and all restitution is made (fines, jail time, probation/parole, etc.) for that charge, it can be expunged for a court filing fee and fill out the forms yourself. My charge was a 3Rd degree misdemeanor which my probation will be finished May 2009. 1 year from conviction to expungment! Pretty sweet! :icon_porc:

    I plead guilty to Assault Causing Bodily Injury, Class A Misdemeanor, 90 days in jail with anger management classes....it took me one phone call to get a local driving job getting out of jail. Of course 16 years driving experience helped too.
