He just wanted to get down the road. Like I said before he put his wants and needs ahead of everything. Short term thinking not a professional for sure. He would need to be superhuman for me to overlook this and not fire him. At the minimum he gets a written warning and loses his performance bonus. Don’t think it’s legal to deduct pay or make him pay the fine but if a portion of his pay is a bonus you can work with that. I used to pay $50/wk plus $50 per good inspection. These days I would probably double both those. I actually liked when I had to pay those outLast edited: Sep 6, 2018

Than why does virginia fine the company???
Ita not even a real law more like a tax if anything... Carrys no points..
Making the driver pay for the fine is punishment enuf since well it was completly avoidable...
Now if he wants to quit instead of paying so be it. But it wonr hurt him to find a new job the following day with out any problems whats so ever... -
They fine the company so they can collect more money. What driver would pay a $1500 fine?
State laws vary but I’m Just saying HERE it would be asking for wrongful dismissal suit if I said “pay or quit”. His lawyer would argue it was constructive dismissal because the driver couldn’t afford to pay therefore he was forced to quit even though he did nothing wrong. Driver must not have done anything wrong because he didn’t get fired right?
Also illegal here to deduct pay.
OTOH, pretty sure I could fire him outright for failing to follow the law.Socal Xpress Thanks this. -
They fine the company no matter what usually because like you said the driver usually don’t have the money to pay the fines. I think some things should go toward driver such as load securement but it doesn’t. It’s up the driver to respect the company enough to do the right thing but some don’t. I actually got a call one day from a unknown number saying I got the name off the side of your truck and you have a chain dragging the pavement on 95. I said I will find out. I called driver and said pull over you are dragging a .... chain! He said no I’m not and I said I just got a call. He pulled over and said yep I am. I said you see the bungees I have on the back? That’s to secure the chains! This trailer is set up for concrete pipe only with cables and chains. Until you own trucks you never really understand how uncommon common sense is.singlescrewshaker, rank and xsetra Thank this.
