    Holy crap, thats a tall order just to drive a truck. I was never even asked why I had not worked for 1 1/2 years prior to taking current job

    Thank you @roshea you pasted that regulation now I don't have to. @Ridgeline you need to go look at 391.21. This section also refers back to part 383 and in this part is where the CMV driving history is mentioned. In post #4 I made an error and said CDL for the 10 year history and that should have been CMV that was a mistake. However the exact rule is a 3+7 = 10 situation ((11) For those drivers applying to operate a commercial motor vehicle as defined by part 383 of this subchapter, a list of the names and addresses of the applicant's employers during the 7-year period preceding the 3 years contained in paragraph (b)(10) of this section for which the applicant was an operator of a commercial motor vehicle, together with the dates of employment and the reasons for leaving such employment;)

    These are only minimums and a carrier is free to add years. This information is required in driver qualification files and a sampling of these files are examined by the FMCSA when they do a compliance audit. In fact a guy I know has just recently been audited and got cited by the FMCSA because of incomplete DQFs. To summarize. YOU are required to give a carrier a 3 year job history regardless and if you have driven CMVs go back another 7 years. This is spelled out in black and white and is NOT my opinion. As to being around the hiring process no i don't do actual hiring. However almost every business day I am in contact with a HR or safety critter and we do discuss this.

    I belive what FMCSA is saying is 3 years, if you are APPLYING to drive a CMV , as HOS applies to you, then you need a total of 10 years history. I believe that is how the officer that did my compliance explained it to me. You can apply to be a clerk, dispatcher, whatever and still only need 3 years ,even if you drove a truck before. As soon as you say you will be under HOS it's 10 years, whether you drove a CMV before or not.

    As for Emily, she is employable. Just fill out the apps. and if possible find your W-2 forms for those 6 mos. you did work a W-2 job.
    It's common to have done odd jobs; waitress, cleaning homes, etc. for cash and not having any proof. You can say you were unemployed, but doing odd jobs for cash.
    Now the tough question. Can you pass a drug test?
    All companies are required to give drug tests.
    You need to be clean 12 mos. for hair follicle drug test.
    You need to be clean 90 days for urine test.
    Some companies give urine test and some give hair follicle.
    If we know which test you prefer then we know which companies to recommend to you.

    Don't over complicate it. The FMCSA demands ANYBODY seeking work and to be considered for hire to give the carrier a 3 year job history (with any type job or employer). THEN if you have ANY job history as the driver of a CMV in the preceding 7 years you MUST list that.

    I'm thinking if you go to public school like a community college or private school for your Cdl I m pretty sure they got something called a Gainful Employment Disclosure Data form that tells people interested in the class the pass rate and employment rate of the class and there's a usually a person that's specifically looking to get students jobs after passing the course so I would find that person at a school you're interested in and ask them your question. A lot of people can get financing thru Pell grants or grants to help people get back into the workforce.

    I remember seeing a picture of I think it was the 1st person to contribute money to social security and it's a little old woman with i think $5. never forgot it because I found out she got hundreds or thousands off the little money she put in. the point is i understand that sometimes off the books is all you can find but remember these people are cheating you big time out of contributions and money from SS later and it could be many thousands lost every year from working off the books. if you haven't already, find out how many points/years of qualifying years you have with social security to get extra cash in retirement.

    i too have worked "under the table", when i was young..NO BIG DEAl...except, you cannot use that employer as a reference, cuz you paid NO TAXES, neither did they on your employment....(if someone wanted to, they can back charge you and the employer for back taxes, but not likely)

    you should be fine, you just have to "account" for your time.. someone mentioned that you jot down, "took care of a sick parent, or something. you "may need" a notarized letter backing that up...

    you will be just fine, money earned under the table is nothing to be ashamed of.

    I don't think I m over over complicating at all. In your own post the regs says " For those drivers applying to operate a commercial motor vehicle". Not if they driven a CMV.
