I had a guy that owned his own truck with his own business name and EIN number that went out of business due to finances. I’ve had a truck sitting that I took off the road and he asked me could I put the truck back on the road and him run some of my loads. He doesn’t want to be an employee and on W2 which is how I pay. He wants to pick the loads that he wants from what I don’t cover. Can I do that legally?

He already failed once because he could not pick loads correctly. What makes you think he will do any better under your numbers?

Don't change your business model.
Put him on W2.
What if he decides not to run enough to cover your costs.
Yes you drop him, after what cost to you?
Or. Agree to run him 1099 after he runs a while as w-2. Just to see if it works for both of you. -
I personally don’t have any experience in owning my own truck or business, but from a common sense standpoint I wouldn’t accommodate the demands of a guy who failed in his own business endeavors. If he picked his loads and went belly up and you let him use your equipment and your money to do the same, that’s like letting a guy who totals his car drive yours.

I'd say no, you're going to run what's is profitable for my business. You give him power to choose loads, you're giving power to deny them as well. Unless they're all close revenue wise, he runs the way you want your business to run. ImOJasonar15 Thanks this.

If that’s the way, then you need to give him W2 and all the benefits. You should offer medical, sick pay, vacation pay, per diem, etc. Also, you shouldn’t force dispatch, coerce drivers and you need to give the drivers plenty of miles, so to keep turn over low.

Did you even read his post? He wants that guy to be on a W2, it's how he operates his business. As for force dispatch, don't like it, then dont work there. As an employer , if your freight base allows, by all means. But this driver wanting to come aboard is raising red flags. He's already lost his business, but now he basically wants to call the shots here , but run the OP truck as his own,,,,,,,which he lost.
Miles are irrelevant. Its pay at the end of the week that is important. I work 4 days a week and gross $1320 driving just under 300 Mile's a day. You do the math as to what that would being paid by the mile.
You dont have to chase miles to make money.
But whatever. There always has to be a smartbuttJustrucking2 and Ruthless Thank this.
