Simple question about setting up LLC while employed as a company driver

I'm with you TruckRunner. We run under the LLC. The main issue is this:

An LLC is a "partnership" if you are a 1 man operation, there is no partner - which is 1 of the many reasons why it's so easy to break through the protection shield that an LLC offers. Now there are several legal ways to get around this and still technically be a 1 man operation. I suggest reading the book Limited Liability Companies for Dummies. It was written by an expert and has a ton of info on asset protection.
I can set you up properly (for a fee of course)...But you can just as easily read up, have a lawyer review & do it yourself.
Another problem is that owners of LLCs don't know how to properly separate their personal dealings from business. You can not mix the two...ever. Business expenses run thru the business & personal bills run thru your personal account. Keep everything separate & get a "partner" and you should be fine with not having your personal assets involved in the event of an accident.
Also, be sure to include the clause about limited liability in your operating agreement.

 

Hell yeah the court included everything they owned except for the retirement. I cringe when I hear some lawyer said this or that because as my lawyer said "until you go to court, it is all bs what a lawyer will tell you because it is all issue specific"
