Home time and drinking.

Family members that are jokers, since then I have stopped all drinking plus they are gun nuts that are impaired so I just walk away when they start.

 

They actually can call you in a middle of a vacation and say go get a test and if you do not they can report it as a refused

 

And yet I've already posted the regs that state otherwise.

 

For the record, this is the only regulation that covers this testing as it relates to if you as a driver have to report or not. If there is other regulations I am not aware. This is in 382.305 (i)

(l) Each employer shall require that each driver who is notified of selection for random alcohol and/or controlled substances testing proceeds to the test site immediately; provided, however, that if the driver is performing a safety-sensitive function, other than driving a commercial motor vehicle, at the time of notification, the employer shall instead ensure that the driver ceases to perform the safety-sensitive function and proceeds to the testing site as soon as possible.

 

Alcohol and drug testing are way different.
Drug test can be anytime

 

If I remember, you posted the alcohol regulation. 382.305 (m). this is not the same.

Which really screws the driver.

Employee: Sorry boss, i cant go because i have been drinking.

Boss: okay, refusal to drug test then?

Is that how it really goes? Never been in that situation.....
