How is this theft? They are ALLOWING HIM TO USE VACATION HE HASNT EARNED YET with the theory being that he will be there for many years to come and it wont matter. There is only a 10% turnover rate in the LTL industry, so any given driver SHOULD be there for a minimum of 9 years on average.

If he uses it BEFORE HE HAS EARNED IT, and then leaves the company, it would be HIM STEALING FROM THE COMPANY, not the company stealing from him!! He took something he didnt have coming. So they take it back. Its really pretty simple. Really.

Its like me promising to pay you 100 bonus dollars if you work for me for 2 weeks, but I will let you have that 100 dollars today so you can buy something to eat, gas, get your car fixed, whatever. If you quit before the 2 weeks is up, then YOU owe ME that 100 dollars because you didnt fulfill your part of the agreement, and I will deduct it from your check. You took it already when you didnt have it coming, so if you dont give it back it is YOU that is stealing. Got it?

And yes, they can get it back even if your last check isnt big enough to pay it all. They have direct deposit (your bank info), your SSN, and any other personal data a collection agency needs to collect. All they need is a judgement from a court (which in this case is a formality) - which YOU will get the bill for (atty fees and court costs). So trying to close your account to try to hide the few hundred bucks you are trying to hide from them will only cost YOU more in the long run.

I have said nothing about closing accounts I have said nothing about hiding money, I have said nothing about Court. I have not said anything about ATTY.

The company failed to inform this worker that this vacation money is being fronted. Im pretty sure he or she signed a stack of forms on hire and one of them is the fronting contract.

When I get vacation pay I always make sure this money is free from future take back or clawback of this nature.

You sir would do well to calm down a little bit.

To the OP, Take that Paycheck (Blocking out any really relevant personal information and frame it on your wall. Or make a meme out of it. I worked 37 hours and all ESTES did pay is .14 #### cents.

First off, you are the one that needs to "calm down". If you had read the other posts, you SHOULD have figured out that I wasnt JUST responding to YOU.

Yes, Estes DOES make it clear in orientation the way vacation works. I worked there 2 years, didnt use a day, and I got my full weeks pay (plus sick leave unused) when I left. Just like they said. They are completely up front about the pay, the vacation, the sick time and how it works. Someone doesnt understand it, and goes to the internet whining Oh Boo Hoo they screwed me! No they didnt. You screwed yourself. If you didnt understand, thats on YOU because they are more than willing to answer any questions.

Like I said, best company I ever worked for. Not to say they dont have any warts, but the pay was #### good and they treated me right, and most importantly (to me) they left me the hell alone and let me do my job!

A bad vacation policy is making your employees wait 2 full years before EARNING any vacation. Seriously, people need a break, and people have families. My company let me take a week off (unpaid) just 9 months after I started, no big deal.

It’s not even about the money to me. I can’t stand places that act like everything will fall apart if you take time off. Luckily, my job isn’t like that, but many places are. A few of my buddies that work for Blackhorse say it’s difficult to use their vacation as is. Idk about Estes, and overall I’ve heard it’s a decent place to work for... but their vacation policy needs improvement.
